The Sit-Ins: Protest and Legal Change in the Civil Rights Era (Chicago Series in Law and Society)
Par Christopher W. Schmidt. 2018
On February 1, 1960, four African American college students entered the Woolworth department store in Greensboro, North Carolina, and sat…
down at the lunch counter. This lunch counter, like most in the American South, refused to serve black customers. The four students remained in their seats until the store closed. In the following days, they returned, joined by growing numbers of fellow students. These “sit-in” demonstrations soon spread to other southern cities, drawing in thousands of students and coalescing into a protest movement that would transform the struggle for racial equality. The Sit-Ins tells the story of the student lunch counter protests and the national debate they sparked over the meaning of the constitutional right of all Americans to equal protection of the law. Christopher W. Schmidt describes how behind the now-iconic scenes of African American college students sitting in quiet defiance at “whites only” lunch counters lies a series of underappreciated legal dilemmas—about the meaning of the Constitution, the capacity of legal institutions to remedy different forms of injustice, and the relationship between legal reform and social change. The students’ actions initiated a national conversation over whether the Constitution’s equal protection clause extended to the activities of private businesses that served the general public. The courts, the traditional focal point for accounts of constitutional disputes, played an important but ultimately secondary role in this story. The great victory of the sit-in movement came not in the Supreme Court, but in Congress, with the passage of the Civil Rights Act of 1964, landmark legislation that recognized the right African American students had claimed for themselves four years earlier. The Sit-Ins invites a broader understanding of how Americans contest and construct the meaning of their Constitution.Church State Corporation: Construing Religion in US Law
Par Winnifred Fallers Sullivan. 2020
Church and state: a simple phrase that reflects one of the most famous and fraught relationships in the history of…
the United States. But what exactly is “the church,” and how is it understood in US law today? In Church State Corporation, religion and law scholar Winnifred Fallers Sullivan uncovers the deeply ambiguous and often unacknowledged ways in which Christian theology remains alive and at work in the American legal imagination. Through readings of the opinions of the US Supreme Court and other legal texts, Sullivan shows how “the church” as a religious collective is granted special privilege in US law. In-depth analyses of Hosanna-Tabor v. EEOC and Burwell v. Hobby Lobby reveal that the law tends to honor the religious rights of the group—whether in the form of a church, as in Hosanna-Tabor, or in corporate form, as in Hobby Lobby—over the rights of the individual, offering corporate religious entities an autonomy denied to their respective members. In discussing the various communities that construct the “church-shaped space” in American law, Sullivan also delves into disputes over church property, the legal exploitation of the black church in the criminal justice system, and the recent case of Masterpiece Cakeshop v. Colorado Civil Rights Commission. Brimming with insight, Church State Corporation provocatively challenges our most basic beliefs about the ties between religion and law in ostensibly secular democracies. On War and Writing
Par Samuel Hynes. 2018
“In our imaginations, war is the name we give to the extremes of violence in our lives, the dark dividing…
opposite of the connecting myth, which we call love. War enacts the great antagonisms of history, the agonies of nations; but it also offers metaphors for those other antagonisms, the private battles of our private lives, our conflicts with one another and with the world, and with ourselves.” Samuel Hynes knows war personally: he served as a Marine Corps pilot in the Pacific Theater during World War II, receiving the Distinguished Flying Cross. He has spent his life balancing two careers: pilot and professor of literature. Hynes has written a number of major works of literary criticism, as well as a war-memoir, Flights of Passage, and several books about the World Wars. His writing is sharp, lucid, and has provided some of the most expert, detailed, and empathetic accounts of a disappearing generation of fighters and writers. On War and Writing offers for the first time a selection of Hynes’s essays and introductions that explore the traditions of war writing from the twentieth century to the present. Hynes takes as a given that war itself—the battlefield uproar of actual combat—is unimaginable for those who weren’t there, yet we have never been able to turn away from it. We want to know what war is really like: for a soldier on the Somme; a submariner in the Pacific; a bomber pilot over Germany; a tank commander in the Libyan desert. To learn, we turn again and again to the memories of those who were there, and to the imaginations of those who weren’t, but are poets, or filmmakers, or painters, who give us a sense of these experiences that we can’t possibly know. The essays in this book range from the personal (Hynes’s experience working with documentary master Ken Burns, his recollections of his own days as a combat pilot) to the critical (explorations of the works of writers and artists such as Thomas Hardy, E. E. Cummings, and Cecil Day-Lewis). What we ultimately see in On War and Writing is not military history, not the plans of generals, but the feelings of war, as young men expressed them in journals and poems, and old men remembered them in later years—men like Samuel Hynes.Crime Science: Methods of Forensic Detection
Par Joe Nickell, John F. Fischer. 1999

murders. All controversial cases. All investigated with the latest techniques in forensic science. Nationally respected investigators Joe Nickell and John Fischer explain the science behind the criminal investigations that have captured the nation's attention. Crime Science is the only comprehensive guide to forensics. Without being overly technical or treating scientific techniques superficially, the authors introduce readers to the work of firearms experts, document examiners, fingerprint technicians, medical examiners, and forensic anthropologists. Each topic is treated in a separate chapter, in a clear and understandable style. Nickell and Fisher describe fingerprint classification and autopsies, explain how fibers link victims to their killers, and examine the science underlying DNA profiling and toxicological analysis. From weapons analysis to handwriting samples to shoe and tire impressions, Crime Science outlines the indispensable tools and techniques that investigators use to make sense of a crime scene. Each chapter closes with a study of a well-known case, revealing how the principles of forensic science work in practice.A Political Companion to Philip Roth (Political Companions to Great American Authors)
Par Claudia Franziska Brühwiler and Lee Trepanier. 2017
“Demonstrates powerfully the manifold ways in which Roth’s writing often helped to shape, and was in turn shaped by, the…
larger political climate.” —David Brauner, author of Contemporary American FictionWidely acknowledged as one of the twentieth century’s most prolific and acclaimed writers, Philip Roth received the National Book Award for his first novel, Goodbye, Columbus, and followed this stunning debut with more than thirty books—earning another National Book Award, two National Book Critics Circle awards, three PEN/Faulkner Awards, and the Pulitzer Prize. Throughout his career, Roth delighted in controversy—yet often denied that he sought a role as a public intellectual. His statements and vigorous support of suppressed writers in communist Czechoslovakia, however, tell a different story. In A Political Companion to Philip Roth, established and rising scholars explore the myriad political themes in the author’s work. Several of the contributors examine Roth’s writings on Jewish identity, Zionism, and American attitudes toward Israel, as well as the influence of his work in other countries. Others investigate Roth’s articulation of the roles of gender and sexuality in US culture. This interdisciplinary examination offers a more complete portrait of Roth as a public intellectual and cultural icon. It not only fills a gap in scholarship, but also provides a broader perspective on the nature and purpose of the acclaimed writer’s political thought.“Addresses a void in discussions of Roth’s work by looking at his thinking on political matters, particularly as they involve identity, the American Jewish experience, Israel, and Cold War fears of communism.” —ChoiceThe Essential HBO Reader (Essential Readers in Contemporary Media and Culture)

Par Vibe Ulfbeck, Anders Møllmann, Bent Ole Mortensen. 2016
Given the magnitude of the risks associated with commercial activities in the Arctic arising as a result of the milder…
climate, new business opportunities raise important questions of responsibility and liability. This book analyses the issues of responsibility and liability connected with the exploitation of natural resources, marine transport and other activities in the Arctic. Applying a combined private and public law perspective on these issues, it considers both the business and societal interests related to Arctic development using Greenland as an example. The book focuses on problems that are specific to Greenland and wider issues that affect all Arctic states.Postmortem Fingerprinting and Unidentified Human Remains

consolidated and thorough guide to the recovery, identification, and management of unidentified postmortem fingerprint records - topics from postmortem fingerprint processing to database submission and case management are discussed. Additionally, a postmortem processing workflow is described, which delineates various basic and advanced fingerprint recovery techniques used to acquire examination-quality records. Furthermore, Postmortem Fingerprinting and Unidentified Human Remains discusses the complexity of antemortem fingerprint databases and how to access each database for humanitarian purposes, bringing a modern value perspective to the topic. Many of today's most serious issues—homelessness, gun violence, fracking, prison privatization, predatory lending, and many more—resist resolution because the “rights…
of property” undermine the rights of people. Issues that undeniably affect whole communities are determined by the courts to relate primarily to property, contracts, and corporations and are removed from the public sphere and immunized from public governance. There's a reason for this. Ben Price tells the story of how the Federalists—the more conservative faction of the Founding Fathers—secretly drafted the Constitution as a counterrevolutionary document. It restored to the colonial 1 percent privileges overturned by the revolution, avoiding a popular backlash by bestowing rights on wealth itself, rather than creating a British-style personal aristocracy. These rights of property deprive the majority of their ability to self-govern and weaponize government in ways that let the “minority of the opulent” (in James Madison's phrase) use the Constitution to block local policies that compete with their interests. Price details often shocking examples of how the supposedly unalienable rights of individuals and communities are blithely disregarded. But he also describes how over 200 communities have drafted their own bills of rights that push back against the primacy of property and how we all can join this struggle to return America to what the revolutionary generation intended. The Civil Law Tradition: An Introduction to the Legal Systems of Europe and Latin America, Fourth Edition
Par John Henry Merryman, Rogelio Pérez-Perdomo. 2018
Designed for the general reader and students of law, this is a concise history and analysis of the civil law…
tradition, which is dominant in most of Europe, all of Latin America, and many parts of Asia, Africa, and the Middle East. The fourth edition is fully updated to include the latest developments in the field and to correct and update historical details gleaned from newly-published research on Roman and Medieval law. In the past ten years, the legal profession has changed radically, with the growing international ubiquity of large law firms operating across borders (which was previously a uniquely American phenomenon). This new edition updates the book from the post-Soviet era to ongoing current issues, including Brexit and the status of the European Union. It discusses how civil law codes have shifted in some countries to adapt to modern and changing ideologies and also includes brand-new material on legal education, which is of central importance to the legal profession today.Writing the Legal Record: Law Reporters in Nineteenth-Century Kentucky

This open access book aims to provide an initial but comprehensive roadmap for the Chinese civil litigation system. It starts…
with some basic concepts of the Chinese judicial system (e.g., court system, case numbering, hierarchical trial system, etc.) and runs through the entire process and most aspects of civil litigation cases (e.g., jurisdiction, service of process, rules of evidence, enforcement, representative actions, etc.). The first target audience for this book is lawyers outside of mainland China. For professors and law students, this book also serves as a window into the Chinese judicial system in a short period of time. It is my hope that this book serves as a backdrop for additional observations of Chinese judicial practice, such as a review of recent cases. This is an open access book.Computer Forensics: Cybercriminals, Laws, and Evidence

Par Roy Blount Jr.. 1984
Laugh-out-loud observations from “America’s foremost humorist” (Chicago Tribune). What Men Don’t Tell Women: Well, that’s just for starters. Roy Blount…
Jr. realized that nearly all of his writing involved things people don’t tell people: what Southerners don’t tell Northerners, what the sick don’t want to hear from the well, what no one would ever tell their mother, and what authors rarely admit to their readers. That all changes in this “honest . . . funny” collection of confessional essays about sex, friendship, marriage, male bonding, female patience, and Elvis (The Boston Globe). One Fell Soup: A deliciously funny stew of reviews, diatribes, investigations, meditations, assorted grumblings, and verse about the absurdities of American life, death, fears, and ambition. Included in these fifty-nine easy pieces: the truth (as Blount sees it) about nudism, cricket-fighting, bowling, macaroni and cheese, black holes and black socks, nuclear holocausts, the CIA, domesticated fowl, pork bellies, God, and more. The whole shebang from “one of the most clever (see sly, witty, cunning, nimble) wordsmiths cavorting in the English language” (Carl Hiaasen). Camels Are Easy, Comedy’s Hard: Flesh-eating piranha! Synchronized swimming! Rubber chickens! Edith Wharton! Crossword puzzles! All and then some in this giddy compendium of essays, celebrity profiles, silly games, and side trips. Parts sports journalism, literary criticism, travel writing, and aborted novel, tossed with a few poems and a neo-Biblical one-act play, this is an uproarious—and sometimes heartening—anthology of adventures from “one writer who never fails to please” (The Village Voice).Delayed Transitional Justice: Lessons from Spain, Brazil, and Uruguay
Par Mariana S. Mendes. 2024
This book addresses the issue of the timing of transitional justice policies in countries that had negotiated transitions from authoritarianism…
to democracy. Why are transitional justice measures often being implemented decades after the events they refer to? More specifically, what combination of factors leads to the implementation of transitional justice policies at certain moments in time? And, what explains countries’ different choices and trajectories? To address these questions, this book pursues a comparative analysis of three cases: comparing a case of ‘robust’ implementation of transitional justice measures (Uruguay), a case where only victim-centered measures were approved (Spain), and a case that sits in between these two (Brazil). Through an in-depth empirical analysis of these specific country-cases, and focusing on seven different transitional justice initiatives, the book identifies the determinants behind delayed transitional justice policies and explains why such policies are more robust in some settings than in others. In doing so, it provides a holistic account of post-transitional justice outcomes, offering more general conclusions and insights about the study of the drivers of transitional justice. This book will appeal to scholars and students of transitional justice in politics, law, and sociology, as well as to policymakers involved in the implementation and administration of transitional justice measures. The role of law in responding to global environmental problems and the interplay between different levels of regulation and governance…
is becoming increasingly relevant in the field of liability and reparation for environmental damage. This book examines the relationship and reciprocal influences between the EU and the international legal order in a multilevel and comparative perspective, in relation to the ongoing efforts to elaborate effective regimes of liability and reparation for environmental damage. It offers a comparative analysis of legal developments in the field of environmental liability within the EU and at the international law level and addresses questions concerning the impact of such interaction on the development, implementation and enforcement of appropriate responses to environmental damage within the respective legal orders and on a global level. Given the book’s focus and the transnational legal dimension of the issues covered, this volume will be of great interest to legal academics and researchers working in the environmental law field from an EU law and international law perspective, as well as more generally to scholars interested in the study of the relationship between EU and international law. Outside academia, the book will also be of great interest to practitioners wishing to get insights into the application of the law of environmental liability in the EU and at the international law level.Reimagining the International Legal Order (Law, Ethics and Governance)

law. Legal scholars often prefer not to challenge the status quo, to suggest amendments, or to reform institutions, advocating simply to focus on the implementation of the laws that already exist. This collection stands different. It shares the authors’ discomfort with the present legal order and some of its institutions and courts, and dives into either a corrective or a profound reimagination of these, so that they can better address rising global challenges. Leading experts in their areas present their new and cutting-edge perspectives. Divided into six parts, the volume paints a vast yet solid thematic landscape of unique and critical approaches. The book invites and allows for a deep engagement with a wide range of opinions from across the world. It enables a free and courageous reimagining of the international legal order, detached from the endless feasibility skepticism. The work will be fascinating reading for students, academics and researchers working in the areas of International Law and International Relations.

This book continues the discussion from Volume I on economic, fiscal, and financial crises in world history that have had…
a great impact on the entire world and the fiscal measures taken by governments to combat each crisis. Such events are often described as black swans, a concept introduced by Economist and Risk Analyst Nassim Nicholas Taleb in the book Fooled By Randomness in 2001, in reference to events that were thought to be impossible but had a huge impact when they did happen. The beginning of this book notes that crises are catastrophic periods when the consequences of economic mistakes made by governments are reflected to the public. Although economic crises are seen as opportunities in some cases, they have created a burden for the people. Some economic crises even triggered the world war. A recent example, Adolf Hitler, was seen as a hope of salvation in Germany due to the Great Depression and was brought to power. The twentieth century, when two great world wars took place on the stage of history, is the witness of major economic crises as well as wars. These crises have caused social and economic paradigm shifts to be experienced much faster and more effectively than the previous centuries. The transformation of the demand-oriented economic understanding created by the Great Depression in 1929 into an interventionist social state understanding, especially after the World War Two, increased the intervention of states in the socioeconomic field. In this period, the reconstruction of the countries, the development of social welfare services, the assurance of human rights, the acceleration of industrialization and development, and the economic growth and income growth of the countries resulted in the golden age enjoyed by the societies of the period. The interventionist social state, seen as a prescription and opportunity in the past crisis, was one of the cornerstones of the crisis in the last quarter of the century in the 1970s. Against interventionism, with the rise of neo-liberalism, financial liberalization, information society, and technological discoveries, globalization has become the new phenomenon of the age. This book examines in detail the causes, occurrences, and results of the twentieth-century crises.
