Par Joseph N. Patten, Robert H. Scott III, Kenneth Mitchell. 2023
This book traces how the student loan system has created insurmountable student debt traps for millions of student borrowers contrary to…
its original purpose of promoting social mobility. Today, approximately 45 million Americans hold over $1.7 trillion in student loan debt, with over 20% of borrowers in default. Student loan debt has the greatest negative impact of wealth-poor students, with Black and first-generation students less likely to attain a college degree, more likely to default on student loan debt, and less likely to gain the same type of wage premium from their college degrees than white student loan borrowers. The book also offers a wide range of policy solutions for remedying the student loan debt crisis.Partners with Power: The Social Transformation of the Large Law Firm

Par Alexandria Ruble. 2023
In 1900, German legislators passed the Civil Code, a controversial law that designated women as second-class citizens with regard to…
marriage, parental rights, and marital property. Despite the upheavals in early twentieth-century Germany – the fall of the German Empire after the First World War, the tumultuous Weimar Republic, and the destructive Third Reich – the Civil Code remained the law of the land. After Nazi Germany’s defeat in 1945 and the founding of East and West Germany, legislators in both states finally replaced the old law with new versions that expanded women’s rights in marriage and the family. Entangled Emancipation reveals how the complex relationship between the divided Germanys in the early Cold War catalysed but sometimes blocked efforts to reshape legal understandings of gender and the family after decades of inequality. Using methods drawn from gender history and discourse analysis, the book restores the history of the women’s movements in East and West Germany. Entangled Emancipation ultimately explores the parallel processes through which East and West Germany reimagined, negotiated, and created new civil laws governing women’s rights after the Second World War.Agents and Structures in Cross-Border Governance: North American and European Perspectives
Par Tony Payan, Bruno Dupeyron, Andrea Noferini. 2023
In North America and Europe, cross-border governance arrangements have provided formal and informal frameworks to support cross-border cooperation. Analysing how…
these frameworks have emerged, the ways in which they have become institutionalized, and the processes by which they change is fundamental. Moreover, these frameworks are increasingly challenged by border securitization, thus limiting or jeopardizing decades of cross-border cooperative governance and coordinated public policies. Agents and Structures in Cross-Border Governance offers a series of case studies that explore these complex dynamics. To understand a range of cross-border governance frameworks, this collection addresses such topics as infrastructure development and management, resource sharing, regional politics, economics, security, human rights, the environment, culture, and community. The book explains how cross-border governance schemes have sought to mitigate some of the negative consequences of border security policies, allowing readers to discern how concrete national power struggles between federal/national and subnational governments unfold in border areas. In a world increasingly impacted by climate change and more recently the COVID-19 pandemic, Agents and Structures in Cross-Border Governance sheds light on the ongoing complexity of cross-border governance and offers lessons to help mitigate these challenges.Police and Community in Japan

Par Jean-Claude N. Ashukem, Semie M. Sama. 2024
The relationship between human rights and the environment, as evidenced by the recent UN Resolution on the human right to…
a healthy environment, is a topical, fascinating, uneasy, and increasingly urgent one. This timely collection explores the inextricable relationship between human rights and the environment as a critical lens for understanding and addressing key human rights and environmental issues confronting Africa. The work explores theoretical, philosophical, doctrinal, and empirical research to interrogate and provide clarity on how and whether the human rights-based approach to environmental protection and policy implications has been effective in enhancing environmental protection and sustainability in Africa. It brings together an elite group of African and international experts to investigate the increasing connectivity and problems with African human rights, environmental governance, and the quest for sustainability. The book is divided into thematic clusters, including: the right of vulnerable communities to sustainability; climate change, the right to development and natural resource governance; corporate environmental responsibility and sustainability; the philosophy of environmental ethics and theories of human rights approaches to environmental governance; procedural environmental rights; the role of the judiciary in environmental protection; and desertification. These themes provide a structure to investigate and clarify specific fundamental questions on Africa’s environmental governance paradigm. This innovative contribution provides an interdisciplinary approach to the philosophical interrelationship and use of human rights approaches to ensure and enhance environmental protection and sustainability. As such, the book will be of interest to African scholars, researchers and students in Human Rights Law, Environmental Studies, Political Science, Ecology and Conservation and Development Studies. It will also be a valuable resource for policymakers, governments, NGOs, practitioners, and all those interested in African environmental governance. The Evolution of the Gender Pay Gap: A Comparative Perspective
Par Frances Hamilton, Elisabeth Griffiths. 2024
Through interdisciplinary research, this book explores the continued cause of the significant gender pay gap that still exists in many…
countries today. This gap persists despite a wide range of measures having been introduced to protect women at work. Internationally varied approaches which have been attempted include prohibiting discrimination, maternity leave, maternity pay, health and safety protections for pregnant workers, tax breaks, childcare vouchers, shared parental leave, and gender pay gap reporting. This volume makes a significant and original contribution by tackling the topic through fresh historical and activist approaches, specific consideration of certain professions, and topical issues, such as the gig economy, treatment of carers post-coronavirus, and developing approaches to prosecuting pay equity claims. Our comparative approach interrogates how countries studied in this volume have had varying approaches and differing success in tackling this pervasive issue of the gender pay gap. Lessons to learn regarding policy reform are included in chapters from authors based not only in the UK but also in the United States, Australia, and the Republic of Ireland and fully developed in the conclusion.Human trafficking is a multi-faceted crime. It suffers from definitional and implementation problems. One facet, the focus of this book,…
is the transnational nature of much of the crime, and the need for practitioners to operate across borders to combat it. Europe has taken a distinctive approach to cross border law enforcement and judicial cooperation, which could be used as a model in other areas of the world. This publication examines these problems from a Council of Europe and European Union perspective, including the now post-Brexit UK. The UK has adopted a distinctive approach to legislating and operationalising its trafficking in human beings (THB) legal frameworks, also legislating for “slavery, servitude, forced and compulsory labour”, resulting in distinctive results in internal UK law enforcement. It is argued here that this approach and the results should inform THB legislative and operational developments more widely. Further action in legal and operational frameworks is, however, clearly needed and the book advocates the adoption of a human security “freedom from fear” approach. Ultimately, the interaction of different legal frameworks, and different jurisdictions requires transnational practitioners to adopt a constructivist approach, as was adopted for the development of the internal EU area of freedom, security and justice. The book will be of interest to academics, researchers and policy-makers working in the areas of transnational law, migration law, criminology and international relations.Administrative Law: The Informal Process

Par Jean-Claude N. Ashukem, Semie M. Sama. 2024
This book explores African domestic and regional responses and approaches to environmental protection and sustainability. Written by African experts, the…
collection consists of five parts covering the whole of Africa. It provides broad coverage of specific themes, including environmental constitutionalism, climate change, gender and the environment, wildlife trade, environmental justice, and human displacement. The key aims are first, to explore theoretical and empirical studies to interrogate and provide clarity on academic discourse on how and whether environmental human rights approaches and policy implications have effectively enhanced environmental protection and sustainability at African domestic levels. Second, to investigate and present innovative solutions on how African domestic legal regimes deal with environmental justice, natural resources governance, refugees’ environmental rights, and climate-induced displaced persons. Finally, to propose innovative legal and institutionalised solutions to Africa’s ecological realities by determining the legal and regulatory gaps on environmental human rights issues on the continent. The collection will be a valuable resource for researchers, academics, and policymakers in human rights law, environmental law, political science, ecology and conservation, environmental management, disaster management, and development studies.Technologie, sozialer Wandel und menschliches Verhalten: Einfluss für Wirkung
Par Cornelia C. Walther. 2023

Conciliation of Construction Industry Disputes
Par Brian Bond. 2024
Conciliation of Construction Industry Disputes describes Conciliation as it has evolved and been practised in Ireland for the past 25…
years and provides readers with practical guidance on this Alternative Dispute Resolution (ADR) method. Conciliation combines advantages of both mediation and adjudication and has been very widely practiced in Ireland over the last 25 years. It is low cost, quick and has been hugely successful. It continues to be the most used and preferred method of resolution of disputes in Irish construction contracts despite the introduction of statutory adjudication. The book includes a comparison of the various methods of ADR and will assess how Conciliation fits into them, noting the pros and cons of each. Conciliation is described in detail and the reasons for its success are analysed. This book provides comprehensive guidance on how conciliation should be conducted to maximise its chance of being successful. Drawing on his wide experience of resolving disputes by conciliation, Brian Bond illustrates the problems which can be encountered and how they may be overcome. This book will be useful reading for all involved in construction contracts, construction managers, lawyers and legal advisers, conciliators, those aspiring to become conciliators and anyone looking for an alternative dispute resolution method to a construction contracts dispute.Public health law has been a subject of much controversy and contestation, especially since the COVID-19 pandemic broke out. This…
timely book inquires into the foundational principles of a form of public health law that takes seriously the inherent dignity of the human person. Written from a multidisciplinary perspective, this illuminating study makes the case that the rule of law, just as much as population health, is an essential determinant of human well-being. Choosing the case of the Hong Kong Special Administrative Region of the People’s Republic of China, where life expectancy is among the highest in the world, yet whose well-established rule of law tradition is oft perceived to be under strain, in describing the central dilemmas of public health law, it makes an original contribution to our knowledge of comparative public health law and public health ethics. Situating Hong Kong’s public health law in the context of global health, The Law and Regulation of Public Health should appeal across the world to students and scholars of public health, medical law, public law, comparative law, and international law. It accessibly explains the law to epidemiologists and public health policymakers, and public health to jurists and legal practitioners. This book lucidly urges professionals of public health and law to reflect on how the myriad legal instruments and legal institutions should best be used to promote and protect public health in ways that are at once ethical and lawful. It is a must read for anyone who is interested in gaining insights into public health law and regulation in this highly internationalised Chinese Special Administrative Region.
