International Human Rights and Local Courts: Human Rights Interpretation in Indonesia (Routledge Research in Human Rights Law)
Par Aksel Tømte, Eko Riyadi. 2024
This book addresses the technicalities of how international human rights law can be applied at the domestic level through a…
case study of the human rights methodology of the Indonesian judiciary. Numerous international human rights treaties have been ratified by States parties all around the world. However, local implementation has proven a difficult task for national authorities with every State struggling to realize rights to varying degrees. This reveals a gap between the standards of human rights as envisaged by the law and those experienced by rights holders at the local level. This work analyses how Indonesian courts interpret and apply human rights. It discusses the position of human rights within specific areas of Indonesian law: constitutional law, criminal law and private law. It analyses how courts have dealt with specific cases within these fields of law. Its key contribution lies in its detailed attention to the role of the Indonesian judiciary in implementing human rights, as well as to the influence of international law, and the role that actors other than the judiciary play in this process. It also incorporates international comparative perspectives. The book will be of particular interest to human rights scholars concerned with national judiciaries’ role in human rights implementation, and to scholars, judges, civil society actors and legal practitioners working with law and human rights in Indonesia. How Australia is Studied in China (ISSN)
Par Richard Hu, Diane Hu. 2024
China has arguably the largest community of Australian studies in the world. However, not much is known about this phenomenon,…
including its emergence, rationale, interests, influences, and the implications for strategic Australia-China engagement in a region of increasing challenge and uncertainty. This volume unpacks how Australia is taught, learnt, researched, communicated, and promoted in the Asian giant as well as its largest trade partner. Produced at a critical moment of commemorating half a century of China-Australia diplomatic relations and four decades of formalised Australian studies in China, this volume provides an up-to-date, comprehensive, and insightful examination of this Australia-China engagement. It will be of interest to scholars, students, policymakers, and general readers in areas of Australian studies, Chinese studies, Asia-Pacific studies, China-Australia relations, and international relations.COVID-19 in South Asia: Society, Economics and Politics

Par Claire Freeman, Etienne Nel. 2024
As the world has become increasingly urbanised and planetary well-being ever more threatened, questions have emerged over just what the…
priorities should be for how we live in cities. Clearly for many the current ways of planning and managing city environments are not working, given so many of their human and non-human inhabitants struggle on a daily basis to maintain their well-being and survival. Different approaches to city development are crucial if they are to be inclusive places where all can thrive. Ensuring that cities are safe and sustainable and provide a level of care for all their residents places a significant mandate on those who manage cities and on planners in particular. This book examines all the parts of the city where care needs to be incorporated, how we plan, create nurturing environments, include all who live there, build sensitively, support meaningful livelihoods, and enable compassionate governance. With planners in mind this book examines why care is needed in the urban environment, and drawing on real world examples examines how it can be applied in an effective and empowering fashion.Theatre Work: Reimagining the Labor of Theatrical Production
Par Brídín Clements Cotton, Natalie Robin. 2024
Theatre Work: Reimagining the Labor of Theatrical Production investigates both the history and current realities of life and work in…
professional theatrical production in the United States and explores labor practices that are equitable, accessible, and sustainable. In this book, Brídín Clements Cotton and Natalie Robin investigate the question of artmaking, specifically theatrical production, as work. When the art is the work, how do employers navigate the balance between creative freedom and these equitable, accessible, and sustainable personnel processes? Do theatrical production operations value the worker? Through data analyses, worker narratives, and analogues to the evolving gig economy, Theatre Work questions everything about theatrical production work – including our shared history, ways of operating, and assumptions about how theatre is made – and considers what might happen if the American Theatre was reborn in an entirely new form.Written for members of the theatrical production workplace, leaders of theatrical institutions and productions, labor organizers, and industry union leaders, Theatre Work: Reimagining the Labor of Theatrical Production speaks to the ways that employers and workers can reimagine how we work. This book examines the underlying conditions that give rise to states that are effective, efficient, and bureaucratically inclusive with their…
developmental policies. In spite of humanity’s significant advancements in science, technology and institutionalization of universal human rights conventions in the last seven decades, many countries are still failing to achieve successful development results. As a result, enormous levels of inequality, poverty, and malnutrition prevail. This book focuses on the role of the state in the political economy of development, tracing the socio-economic origins of effective state institutions from a comparative historical-institutional perspective. Drawing on the case studies of South Korea, Brazil, India, Spain, France, and England, the study looks at how good state institutions form, and why these are central to the socioeconomic advancement of their populations. The book contends that effective developmental states are those in which state actors are able to effectively diminish and co-opt the power of the country’s landed elites during the early years of state building. Effectively, the power balance between these two classes determines the developmental trajectory of the state. Considering agrarian reform as the foremost indispensable policy tool to open conditions for positive changes in effective taxation, education, healthcare, and strategic sustainable industrial policies, this analysis offers a significant contribution to the literature on the sociology of institutions and the political economy of development. As well as being a key reading for advanced students and researchers in these areas, this book draws real-life policy lessons for practitioners and policy makers in the developing world. The Struggle over Law in Europe (ISSN)
Par Aldo Sandulli. 2024
This book examines the role of law in Europe at a time when economic policies have become dominant not only…
on this continent but globally. Can law be seen as a mere infrastructure? Or does it contribute to defining the social and legal order through its own inherent rules? If the second hypothesis is true, what might these rules be, and how may they be identified? Lastly, to what extent can agreeing a definition of the role of law affect the future of Europe? With the Next Generation European Union, the EU has introduced an unprecedented investment plan for economic recovery and resilience. In doing so, it has become the most important financial intermediary on the continent. But is this simply the prelude to a European economic and financial revival, or does it also aim to strengthen the European legal order in social, political, and constitutional terms? This book argues that the role of law in Europe should be to achieve a balanced relationship between freedom and solidarity; encouraging economic competition, but also social cohesion. Analyzing the role of law in the project of European integration, it maintains that law should be more than an infrastructure for finance and economics, showing how it can act as a guide and a binding force to achieve a more balanced relationship between economics, politics, and law. This book will be of interest to scholars in the fields of public law, European law, law and economics, the philosophy of law, legal history, political theory, and political science, as well as others concerned with the future of European integration.Sonic Rebellions: Sound and Social Justice

Par M. Ehteshamul Bari, Uday Shankar. 2024
This book sheds light on the fact that the proclamation of an emergency can be a legitimate constitutional method to take…
prompt preventative measures in protecting the interests of the society in times of grave crises. However, the exercise of emergency powers should not undermine a nation’s commitment to democratic values, such as maintaining the rule of law and upholding fundamental human rights. The COVID-19 pandemic has posed grave threats to the lives and health of individuals. However, since the constitutions of South Asian nations do not permit the proclamation of an emergency on health grounds, executives of these nations were constrained to rely, among other things, on ordinary legislation to tide over the threats posed by the pandemic. Although these statutes entrust the executive with extensive emergency powers, they do not simultaneously stipulate any safeguards subjecting the exercise of such powers to a reliable system of checks and balances. Accordingly, this book critically examines the exercise of emergency powers in the South Asian nations to tide over threats posed by the COVID-19 pandemic, which had a profoundly adverse impact on the human rights of individuals. Such exercise of powers was consistent with the general tendency demonstrated by succeeding generations of the executives in these nations to use emergency situations as the convenient means for imposing long-lasting limitations on the rights of individuals. Consequently, this book identifies the flaws, deficiencies, and lacunae of the legal framework in these nations, which permit the executive to assume unfettered power in the exercise of emergency measures at the expense of the liberty of individuals. Consequently, based on these findings, recommendations will be put forward for initiating reforms in these nations aimed at ensuring the maintenance of a delicate balance between the necessity to respond tograve threats and to simultaneously prevent undue intrusion on the fundamental human rights of individuals.Return Migration and Crises in Non-Western Countries (Mobility & Politics)

Par Marcos González Hernando, Gerry Mitchell. 2023
In highly unequal societies such as the UK, where the top 10% take a higher share of disposable income than…
in most other European countries, many feel resentment towards high earners. On paper, they are doing well, but inequality isn’t even working for them. Uncomfortably Off reveals that those generally considered to be the most affluent feel anxious about the future and struggle to keep up, or even to stay put. They are starting to doubt their common sense ideas about hard work and meritocracy as work pays less and less and life is becoming more uncomfortable. This book makes two crucial arguments. First, reducing income inequality will benefit everyone, even those quite near the top. Second, we need to understand the anxieties of high earners to understand their politics. As leading managers and professionals they have disproportionate influence on the institutions that rule over our public life. Their interests are ultimately not that dissimilar from those of the median earner: being able to afford a good quality of life in an ever more expensive and uncertain world. The hope of this book is to prompt high earners to question accepted truths and long-held beliefs that affect how they see themselves and judge others. In doing so, it seeks to help us all understand why dismissing the concerns of this group will not help in the fight to solve inequality. What Price Israel?: 50th Anniversary Edition 1953-2003

and from isolation to an industrial leadership role. The book concludes that Chinese stakeholders are not seeking to fragment the Internet but are rather integrating in the existing global Internet governance mechanisms while adopting strong regulation domestically. This counters a widespread media (and academic) narrative on China as the promoter of an alternative Internet and/or an alternative model of Internet governance. These conclusions are reached through a mix of qualitative methods, including interviews with people involved first-hand in Internet governance, such as technologists engaged in the making of Internet and mobile connectivity standards. This book examines the efforts of the government in Scotland to manage the increase of migrants travelling to Britain at…
the end of the nineteenth century. Focussing on the period between 1885 and 1939, the book explores how the Scottish machinery of government handled the administration of ‘foreigners.’ The author uses a comparative, thematic approach to analyse migrant experiences, identities, and relationships with state institutions. Drawing from state records held by the National Records of Scotland in Edinburgh, the book argues that Scottish officials in semi-autonomous boards began to recognise, describe and enumerate the presence of the ‘foreigner’ in the early twentieth century, framing their handling of foreignness in accordance with the Aliens Act of 1905. The author goes on to explain that institutions operating in Scotland developed a distinctly Scottish approach to alien matters, which continued up until the Second Word War. Therefore, an increasing number of importantdecisions affecting migrants were taken by a distinctly Scottish machinery of government, impacting on how Scottish officials understood foreignness, and how those identified as foreigners understood their identity in relation to Scottishness. Contributing significantly to current heated debates on migration and identity amongst researchers and the general public in Europe and beyond, this book provides essential insights into the ways in which a ‘sub-state’ began to develop practices, processes and attitudes towards migration which were not always in line with that of the central government. The Supermajority: How the Supreme Court Divided America
Par Michael Waldman. 2023
A &“terrific, if chilling, account&” (The Guardian) of how the Supreme Court&’s new conservative supermajority is overturning decades of law…
and leading the country in a dangerous political direction. In The Supermajority, Michael Waldman explores the tumultuous 2021–2022 Supreme Court term. He draws deeply on history to examine other times the Court veered from the popular will, provoking controversy, and backlash. And he analyzes the most important new rulings and their implications for the law and for American society. Waldman asks: What can we do when the Supreme Court challenges the country? Over three days in June 2022, the conservative supermajority overturned the constitutional right to abortion, possibly opening the door to reconsider other major privacy rights, as Justice Clarence Thomas urged. The Court sharply limited the authority of the EPA, reducing the prospects for combatting climate change. It radically loosened curbs on guns amid an epidemic of mass shootings. It fully embraced legal theories such as &“originalism&” that will affect thousands of cases throughout the country. These major decisions—and the next wave to come—will have enormous ramifications for every American. It was the most turbulent term in memory—with the leak of the opinion overturning Roe v. Wade, the first Black woman justice sworn in, and the justices turning on each other in public, Waldman previews the 2022–2023 term and how the brewing fights over the Supreme Court and its role that already have begun to reshape politics. The Supermajority is &“a call to action as much as it is a history of the Supreme Court &“ (Financial Times) at a time when the Court&’s dysfunction—and the demand for reform—are at the center of public debate.
