Dark chapter
Par Winnie M Li. 2019
Vivian is a cosmopolitan Taiwanese-American tourist who often escapes her busy life in London through adventure and travel. Johnny is…
a fifteen-year-old Irish teenager living a neglected life on the margins of society. He has grown up in a family where crime is customary, violence is a necessity, and everything-and anyone-can be yours for the taking. As Vivian looks to find her calling professionally, she delights in exploring foreign countries, rolling hillsides, and new cultures. And as a young single woman, she has grown used to experiencing life on her own. But all of that changes when, on one bright spring afternoon in West Belfast, Vivian's path collides with Johnny and culminates in a horrifying act of violence. In the aftermath of the incident, both Johnny and Vivian are forced to confront the chain of events that led to the attack. Vivian must struggle to recapture the woman that she was and the woman she aspired to be, while dealing with a culture and judicial system that treats assault victims as less than human. Johnny, meanwhile, flees to the sanctity of his transitory Irish clan. But when he is finally brought to reckon for his crimes, Vivian learns that justice is not always as swift or as fair as she would hopeNovel Judgements: Legal Theory as Fiction

judgements departs from ‘socio-legal’ studies of law and literature, often dated in their focus on past lawyering and court processes. This texts ‘theoretical turn’ renders the period’s ‘law-and-literature’ relevant to today’s readers because the nineteenth century novel, when "read jurisprudentially", abounds in representations of law’s controlling concepts, many of which are still with us today. Rights, justice, law’s morality; each are encoded novelistically in stock devices such as the country house, friendship, love, courtship and marriage. In so rendering the public (law) as private (domesticity), these novels expose for legal and literary scholars alike the ways in which law comes to mediate all relationships—individual and collective, personal and political—during the nineteenth century, a period as much under the Rule of Law as the reign of Capital. So these novels pass judgement—a novel judgement—on the extent to which the nineteenth century’s idea of law is collusive with that era’s Capital, thereby opening up the possibility of a new legal theoretical position: that of a critique of the law and a law of critique.Chilling Effect: A Lucinda Hayes Mystery

This book considers how law is always enacted, or performed, in ways that can be analyzed in relation to fiction,…
theatre, and other dramatic forms. Of necessity, lawyers and judges need to devise techniques to make rules respond situationally. The performance of law supplements, or it extends the reach of, the law-as-written. And, in this respect, the act of lawyering is in many ways an instantiation of acts often associated with, for example, literature and the plastic and performing arts. Combining legal theory and legal practice, this book maintains that the modes of enquiry found in, and applied to, novels, paintings, and plays can help us understand how things like legal arguments and trials work—or don’t. As such, and through the examination of a wide range of both historical and fictional legal cases, the book pursues an interdisciplinary analysis of how law is performed; and, moreover, how legal performances can be accomplished ethically. This book will appeal to scholars and students in sociolegal studies, legal theory, and jurisprudence, as well as those teaching and training in legal practice. The Plea: His client is innocent. interpretation as a mode of literary interpretation, contextualising the opinions and sociological background of literature within the context of the law of its period and examines the inherent role of the law in the construction of the narrative in the literature of the nineteenth century. From the approach to the operation of jurisprudence and legal application, to the prosecution of the poor, the criminological approach to moral panics and the use of the affirmative defence to mitigate women within society, this book explores the ways in which the authors of the period used the novel form as a way of challenging and critiquing the legal operating model of the world in which their characters found themselves; examining the way in which the authors of the period used the novel as a means of critiquing the nature of the role of the law within society, its impact upon the general public, and the reciprocity which exists between legal ideals and the society which manifests those ideals through thought and action. This is a useful text for students of nineteenth-century literature or the law.Novel Judgements: Legal Theory as Fiction
