Novel Judgements: Legal Theory as Fiction

judgements departs from ‘socio-legal’ studies of law and literature, often dated in their focus on past lawyering and court processes. This texts ‘theoretical turn’ renders the period’s ‘law-and-literature’ relevant to today’s readers because the nineteenth century novel, when "read jurisprudentially", abounds in representations of law’s controlling concepts, many of which are still with us today. Rights, justice, law’s morality; each are encoded novelistically in stock devices such as the country house, friendship, love, courtship and marriage. In so rendering the public (law) as private (domesticity), these novels expose for legal and literary scholars alike the ways in which law comes to mediate all relationships—individual and collective, personal and political—during the nineteenth century, a period as much under the Rule of Law as the reign of Capital. So these novels pass judgement—a novel judgement—on the extent to which the nineteenth century’s idea of law is collusive with that era’s Capital, thereby opening up the possibility of a new legal theoretical position: that of a critique of the law and a law of critique.Chilling Effect: A Lucinda Hayes Mystery

Par Randy Gordon. 2023
This book considers how law is always enacted, or performed, in ways that can be analyzed in relation to fiction,…
theatre, and other dramatic forms. Of necessity, lawyers and judges need to devise techniques to make rules respond situationally. The performance of law supplements, or it extends the reach of, the law-as-written. And, in this respect, the act of lawyering is in many ways an instantiation of acts often associated with, for example, literature and the plastic and performing arts. Combining legal theory and legal practice, this book maintains that the modes of enquiry found in, and applied to, novels, paintings, and plays can help us understand how things like legal arguments and trials work—or don’t. As such, and through the examination of a wide range of both historical and fictional legal cases, the book pursues an interdisciplinary analysis of how law is performed; and, moreover, how legal performances can be accomplished ethically. This book will appeal to scholars and students in sociolegal studies, legal theory, and jurisprudence, as well as those teaching and training in legal practice. The Plea: His client is innocent. novel about one of the most famous wedding dresses of the twentieth century - Queen Elizabeth's wedding gown - and the fascinating women who made it. London, 1947: Besieged by a harsh winter, burdened by shortages and rationing, the people of post-war Britain are suffering despite their nation's recent victory. For Ann Hughes and Miriam Dassin, embroiderers at the famed Mayfair fashion house of Norman Hartnell, a glimmer of brightness comes in the form of their unlikely friendship and being chosen for a once-in-a-lifetime honour: taking part in the creation of Princess Elizabeth's wedding gown. Toronto, 2016: Heather Mackenzie seeks to unravel the mystery of a legacy from her late grandmother. How did her beloved nan, who never spoke of her old life in Britain, come to possess the priceless embroideries that so closely resemble the motifs on the stunning gown worn by Queen Elizabeth II at her wedding almost seventy years before? And what was her nan's connection to the celebrated textile artist and Holocaust survivor Miriam Dassin? With The Gown, Jennifer Robson takes us inside the workrooms where one of the most famous wedding gowns in history was created to tell a story of women whose lives are woven together by the pain of survival, the bonds of friendship, and the redemptive power of love.'Robson succeeds in creating a riveting drama of female friendship, of lives fully lived despite unbearable loss, and of the steadfast effort required to bring forth beauty after surviving war' Independent'A great tale of female friendship' The People's FriendLegal Narratives in Victorian Fiction (Among the Victorians and Modernists)

interpretation as a mode of literary interpretation, contextualising the opinions and sociological background of literature within the context of the law of its period and examines the inherent role of the law in the construction of the narrative in the literature of the nineteenth century. From the approach to the operation of jurisprudence and legal application, to the prosecution of the poor, the criminological approach to moral panics and the use of the affirmative defence to mitigate women within society, this book explores the ways in which the authors of the period used the novel form as a way of challenging and critiquing the legal operating model of the world in which their characters found themselves; examining the way in which the authors of the period used the novel as a means of critiquing the nature of the role of the law within society, its impact upon the general public, and the reciprocity which exists between legal ideals and the society which manifests those ideals through thought and action. This is a useful text for students of nineteenth-century literature or the law.Novel Judgements: Legal Theory as Fiction
