Combating Corruption in the Middle East: A Socio-Legal Study of Kuwait (The Law of Financial Crime)
Par Khaled S. Al-Rashidi. 2021
This book examines the phenomenon of ‘grand corruption’ in Kuwait and the pattern in the wider region. Taking an interdisciplinary…
approach, the work places corruption in its sociological, political and economic context to explore the relationship between the characteristics of Kuwait as a state with an endemic corruption problem. It then focuses on laws and regulations as key problem-solving mechanisms. In doing so, it identifies, explores, and assesses the existing counter-corruption laws and regulations in Kuwait in a broad socio-political-economic context. The work goes beyond doctrinal legal research, employing empirical methodology based on semi-structured interviews with elite politicians and professional experts from criminal justice and non-governmental organisations (NGOs). These valuable and original insights are reflected upon throughout the study. The grand corruption that permeates the tier of high-profile officials in Kuwait is replicated in many developing countries where accountability mechanisms regularly suffer from lack of enforcement. The appeal of this book is its application to numerous jurisdictions, and the Gulf Cooperation Council (GCC) countries and Middle East in particular. It will be a valuable resource for academics, researchers, and policymakers working in the areas of financial crime and corruption.Berlingieri on Arrest of Ships Volume II: A Commentary on the 1999 Arrest Convention (Lloyd's Shipping Law Library)

information, detailing the claims in respect of which a ship may be arrested, the conditions for obtaining an order of arrest, the need for a security, the manner by which the ship that has been arrested may be released, the possibility of a multiple arrest and the jurisdiction on the merits. Focused on the 1999 Arrest Convention, volume II provides a unique, thorough, and updated commentary, analysing each provision with reference to its interpretation in a significant number of States Parties. Moreover, the original comments have been reviewed on the basis of the Travaux Préparatoires of the Convention, which the Author has collected and arranged under each article. In addition to this, the Travaux Préparatoires are now included as a new and important appendix to the volume. Written by a renowned expert in the field, and analysing the various conventions relating to the arrest of ships in an article-by-article and paragraph manner, this book is a useful reference tool for practitioners, as well as academics and post-graduate students of maritime law.The Business of the Supreme Court: A Study in the Federal Judicial System
Par James M. Landis. 2006
As Felix Frankfurter and James Landis write in their preface to The Business of the Supreme Court, "To an extraordinary…
degree legal thinking dominates the United States. Every act of government, every law passed by Congress, every treaty ratified by the Senate, every executive order issued by the President is tested by legal considerations and may be subjected to the hazards of litigation. Other Nations, too, have a written Constitution. But no other country in the world leaves to the judiciary the powers which it exercises over us." This classic volume, first published in 1928, originated in a series of articles written by Frankfurter, then a professor of law at Harvard University, and his student, Landis, for the Harvard Law Review. These articles chronicled and analyzed the many judiciary acts that were passed between 1789 and 1925, and illuminated the intimate connection between form and substance in the life of American law. For instance: When a community first decided to enact zoning laws--the Supreme Court had to approve. When the United States made a treaty with Germany following World War I--the Supreme Court had to define the limits and meaning of the treaty.Newly reissued with an introduction by constitutional expert Richard G. Stevens, The Business of the Supreme Court is still as fresh and relevant today as it was when first published. It is a work that will aid the student of the law to both love the law and remain true to its purposes.Children, Nature, Cities
Par Ann Marie Murnaghan, Laura J. Shillington. 1910
Why does the way we think about urban children and urban nature matter? This volume explores how dichotomies between nature/culture,…
rural/urban, and child/adult have structured our understandings about the place of children and nature in the city. By placing children and youth at the center of re-theorising the city as a socio-natural space, the book illustrates how children and youth's relations to and with nature can change adultist perspectives and help create more ecologically and socially just cities. As a key contribution to children's studies, the book engages and enlivens debates in urban political ecology and urban theory, which have not yet treated age as an important axis of difference. With examples from ten localities, the chapters in this volume ask how we can subvert both romanticized and modernist conceptualizations of nature and childhood that conflate innocence and purity with children and nature; the volume asks what happens when we re-invent urban natures with children's needs and perspectives in mind.Form, Art and the Environment: Engaging in Sustainability (Routledge Studies in Culture and Sustainable Development)
Par Nathalie Blanc, Barbara L. Benish. 2017
Form, Art and the Environment: Engaging in Sustainability adopts a pluralistic perspective of environmental artistic processes in order to examine…
the contributions of the arts in promoting sustainable development and culture at a grassroots level and its potential as a catalyst for social change and awareness. This book investigates how community arts, environmental creativity, and the changing role of artists in the Polis contribute to the goal of a sustainable future from a number of interdisciplinary perspectives. From considering the role that art works play in revealing local environmental problems such as biodiversity, public transportation and energy issues, to examining the way in which artists and art works enrich our multidimensional understanding of culture and sustainable development, Form, Art and the Environment advocates the inestimable value of art as an expressive force in promoting sustainable culture and conscious development. Utilising a broad range of case studies and analysis from a body of work collected through the international environmental COAL prize, this book examines the evolution of the relationship between culture and the environment. This book will be of interest to practitioners of the environmental arts, culture and sustainable development and students of Art, Environmental Science, and International Policy and Planning Development.Nations and Capital: The Missing Link in Global Expansion (Routledge Studies in Nationalism and Ethnicity)
Par Zlatko Hadžidedić. 2022
Nations and Capital: The Missing Link in Global Expansion is a groundbreaking analysis of the ultimate reasons for the emergence…
of nations and nationalism, as a socio-political and geopolitical instrument in the global expansion of capitalism. The author provides the missing link in the relationship between nationalism and capitalism and offers a comprehensive critique of classical theories of nationalism, well illustrated by historical examples. He develops an original theory of nations and nationalism, relying on the assumption that the incessant widening of the gap between the capitalist elites and the labouring masses inevitably makes the endless accumulation of capital socially unsustainable. Bridging that gap without changing the structure of society becomes the paramount task for the system, which has to introduce nationalism as a social glue tailored to conceal, but also to cement, the actual polarisation of society. This book will be of great interest to advanced undergraduate students, postgraduate students, and researchers in political science, sociology, history, international relations, security studies, social and political theory, and nationalism studies.Latin America In A New World

Par Marvin G Weinbaum, Chetan Kumar. 1995
This innovative volume offers a comprehensive analysis of the issues surrounding South Asia's precarious security. Going far beyond common considerations…
of border defense and regime, the contributors rigorously trace the social, economic, and ecological origins of present antagonisms. Although careful attention is paid to state military policies in the post-Cold War era—particularly as governments respond to a growing arms trade and nuclear proliferation—the authors also explore the far-reaching implications of environmental degradation and narcotics trafficking for security in the region, arguing that threats such as these transcend boundaries and local political regimes. Exposing the fallacies of purely geopolitical, state-centric models for considering security issues, the authors highlight the complex historical interplay between state and unofficial actors. Concrete applications of their analysis to specific cases—like the Kashmir dispute between Pakistan and India—demonstrate the importance of confidence-building measures and the inefficacy of "zero-sum" approaches to security. Finally, through its dynamic model of security, this volume offers insights into the emerging significance of new regional identities and relations in the next millennium.Trade Unions in the New Society (Routledge Revivals)
Par Harold J. Laski. 1950
First Published in 1950, Trade Unions in the New Society examines the changing significance of trade unionism and the place…
they occupy in the democratic world. Harold J. Laski contrasts their function in a capitalist or socialist society with what it became under Russian totalitarianism. This book explores the relation between trade unions and the public, trade unions and the law and trade unions and democracy to show the impact of developments such as mass production, social security and a planned economy on the position of the working man and considers the proper role of the government in disputes which may affect the basic public welfare. Most important of all, possibly, are Laski’s observations on the desirability of labour activity in organised politics. Trade Unions in the New Society will be of immense interest for scholars and researchers of politics, political economy, labour studies, and for all who are concerned with the future of democracy.SOCIAL RIGHTS IN EUROPE IN AN AGE OF AUSTERITY (Critical Studies in Jurisprudence)
Par Simon Halliday, Stefano Civitarese Matteucci. 2017
This collection of essays examines the promise and limits of social rights in Europe in a time of austerity. Presenting…
in the first instance five national case studies, representing the biggest European economies (UK, France, Germany, Italy and Spain), it offers an account of recent reforms to social welfare and the attempts to resist them through litigation. The case studies are then used as a foundation for theory-building about social rights. This second group of chapters develops theory along two complementary lines: first, they explore the dynamics between social rights, public law, poverty and welfare in times of economic crisis; second, they consider the particular significance of the European context for articulations of, and struggles over, social rights. Employing a range and depth of expertise across Europe, the book constitutes a timely and highly significant contribution to socio-legal scholarship about the character and resilience of social rights in our national and regional constitutional settings. This book compares the foreign military sales policies of the four European non-aligned countries—Austria, Finland, Sweden and Switzerland—using public opinion…
as an explanatory factor. These non-aligned states have accepted a policy of 'armed neutrality'.From Book to Screen: Modern Japanese Literature in Films
Par Keiko I. McDonald. 2000
Of all the world s cinemas, Japan's is perhaps unique in its closeness to the nation's literature, past and contemporary.…
The Western world became aware of this when Akira Kurosawa's Rashomon was awarded the Grand Prize at the Venice film festival in 1951 and the Oscar for best foreign film in 1952. More recent examples include Shohei Imamura's Eel, which won the Palm d'Or (Best Picture) at Cannes in 1997.From Book to Screen breaks new ground by exploring important connections between Japan's modern literary tradition and its national cinema. The first part offers an historical and cultural overview of the working relationship that developed between pure literature and film. It deals with three important periods in which filmmakers relied most heavily on literary works for enriching and developing cinematic art. The second part provides detailed analyses of a dozen literary works and their screen adoptions. The Violent Society: Violent Society
Par Eric Moonman. 1987
From the Foreward: Each chapter of this work is in truth a separate essay or article in which an author…
distinguished in his field treats a different aspect or manifestation of violence in human society. I doubt whether so complete a treatise in so short a compass has been previously attempted. The reader will be left in no doubt when he reflects on what he has read that violence is, and always has been, a feature or a threat in human society- and will remain so. The reason why this must be so is made plain in the early chapters. Violent behaviour is a display of man's aggressive instinct: without that instinct, which he (and she) shares with the rest of the animal kingdom, the human species would not survive. First published in 1987. Routledge is an imprint of Taylor & Francis, an informa company.British Labour Seeks a Foreign Policy, 1900-1940
Par Henry R. Winkler. 2004
Since World War II, the British Labour Party has played a central role in dealing with complex international issues. Achieving…
real power in parliament for the first time, Labour governments have acted responsibly, and are usually in accord with the views of a substantial majority of the British people. Such was not always the case. In British Labour Seeks a Foreign Policy, 1900-1940, Henry R. Winkler synthesizes twenty years' study of the subject to offer the first full-scale treatment of the Labour Party's evolution in foreign affairs. The Labour Party came into existence at the beginning of the twentieth century to deal with the domestic problems of the working class, and it showed relatively little interest in foreign policy issues. In the aftermath of World War I, however, small groups of moderates made the case against the bitter rejection of the Versailles Treaty by many in the Labour Party and the trade union movement. Most of these argued that the League of Nations could be used to remedy some of the deficiencies of the settlement and that such a League must have the sanction of force if it was to be effective.During the 1930s, the failures of the League--in the Far East, Abyssinia, Spain, and Central Europe--compelled some of its advocates to conclude that, League or no League, the threat from Nazi Germany mandated support for a program of preparedness and rearmament even under the aegis of a hated National Government. The result, by 1937, was the final formal abandonment of many of the radical illusions of the twenties and thirties, as Labour reluctantly but formally assumed a posture that enabled it to share in the governance of wartime Britain and to take a key role in dealing with the international issues that emerged in the aftermath of the Second World War.This volume contains valuable lessons on the responsibilities of political parties as well as the pros and cons of specific policies. It is essential reading for understanding Britain's later stands as its leaders tried to adjust to Britain's diminished power in the post-World War II world. The Year Book Of World Affairs 1984
Par George W Keeton, Georg Schwarzenberger. 1985
First published in 1984. The final volume. The Council of the London Institute of World Affairs has carefully reconsidered the…
lessons to be drawn from the Institute's record in its first half-century and reshaped its plans of activities for the 1980s. As in an earlier "cold peace" era, the Council is united in its resolve not to be taken by surprise by any of the contingencies that, on a darkening world scene , must be anticipated in medium-range planning. It is thus only in keeping with comparable action taken in earlier phases of the Institute's existence that the Council has decided to suspend the publication of the Year Book after this Volume .Environmental Law and Enforcement
Par Gregor I. McGregor. 1994
Amid all the laws and regulations on environmental protection and worker safety, what is the responsible business or landowner to…
do? What should the responsible consultant advise? Environmental Law and Enforcement provides you with a practical guide that takes the mystery out of environmental law and related land use controls. The author provides a synopsis of major environmental topics from A to Z and features citations to the major federal statutes in the United States Code (USC) and the Code of Federal Regulations (CFR) so you can easily find governing statutes and regulations. Special sections discuss the use of experts in case preparation and how to be an effective case witness. A checklist for compliance with the National Environmental Policy Act is included. The book covers strategies to cope with landowner liability for hazardous waste, consultant liability for mistakes in hazardous waste site assessments, and guidelines for emergency managers to minimize legal liability. The section on insurance liability provides practical approaches to dealing with insurance companies on hazardous waste claims. The successful organization will manage for environmental protection as a corporate goal, and consequently stays ahead of new government requirements-away from lawyers and lawsuits-and ahead of the competition. Environmental Law and Enforcement gives you the tools you need to achieve this mission.Thinking Politically/h (Pelican Ser.)

Par Shireen Mahdavi. 2001
This book is the first major account of the life and times of a merchant in nineteenth-century Iran or in…
the Middle East. Haj Muhammad Amin al-Zarb (1834?1898) rose from humble beginnings to become one of Iran's wealthiest and most prominent merchants. He built up his wealth as a money changer, a trader in textiles, precious stones, opium, carpets, agricultural products, and staple foodstuffs amongst other goods, and judicious transactions in land. Adept at cultivating powerful connections, he became the principal supplier of luxury goods to the Shah, his court, and members of the ruling elite; served as private banker to the Shah, his prime minister, and influential bureaucrats; and became Master of the Mint. He had agents in all the main towns of Persia and Europe with correspondents in Asia and America.Amin al-Zarb was also an entrepreneur, industrialist, and innovator. Determined to bring to Iran the advances he had witnessed in Europe, he invested in mining, established factories with imported machinery (such as glass, china, and silk reeling), built a railway line, and urged the Shah to establish a national bank. He also became an advocate of reform and curbs on arbitrary rule. He befriended the famous Islamic reformer, Jamal al-Din Afghani. An innovator in business, Amin al-Zarb led a very traditional life at home. Gifted at making money, he was nevertheless a pious man who contributed generously to religious and charitable causes. Shireen Mahdavi draws on hitherto unpublished family archives to write not only a biography of a fascinating nineteenth-century merchant but also a social history of the period. Her portrait of Amin al-Zarb also provides important insights into the economic, social, and political role played by merchants in Iran and elsewhere in the Middle East in the nineteenth century. The Gulf Cooperation Council: Moderation And Stability In An Interdependent World
Par John A. Sandwick. 1987
The Gulf Cooperation Council represents both a model of development and unity in the Arab world and a working example…
of interstate cooperation to other nations. In this volume, contributors describe the rationale for Gulf unity and cooperation and analyze the financial, economic, and legal institutions of the GCC member states (Saudi Arabia, Kuwait, the United Arab Emirates, Oman, Bahrain, and Qatar). They focus on the GCC's role in maintaining stability in the Arabian peninsula, an area that is clearly vital to U.S. interests. Contributors pinpoint the essential elements of GCC unity, including its efforts to obtain optimum economic self-sufficiency, to maximize market share and revenue from oil production, and to establish an integrated legal framework. The GCC's unique security needs, given the member states' vast combined area and thinly spread populations, are also discussed. An overview of the strategic interests and policies of both superpowers toward the region reveals a history of decline in their influence and prestige that is a result, it is argued, of misperceptions and misguided policies. Finally, documentation and bibliographic sections enhance the book's usefulness as a handbook on the GCC and the Arabian Gulf states.Unaccompanied Children in European Migration and Asylum Practices: In Whose Best Interests? (Routledge Research in Asylum, Migration and Refugee Law)
Par Mateja Sedmak, Birgit Sauer, Barbara Gornik. 2017
Unaccompanied minor migrants are underage migrants, who for various reasons leave their country and are separated from their parents or…
legal/customary guardians. Some of them live entirely by themselves, while others join their relatives or other adults in a foreign country. The concept of the best interests of a child is widely applied in international, national legal documents and several guidelines and often pertains to unaccompanied minor migrants given that they are separated from parents, who are not able to exercise their basic parental responsibilities. This book takes an in-depth look at the issues surrounding the best interests of the child in relation to unaccompanied minor migrants drawing on social, legal and political sciences in order to understand children’s rights not only as a matter of positive law but mainly as a social practice depending on personal biographies, community histories and social relations of power. The book tackles the interpretation of the rights of the child and the best interests principle in the case of unaccompanied minor migrants in Europe at political, legal and practical levels. In its first part the book considers theoretical aspects of children’s rights and the best interests of the child in relation to unaccompanied minor migrants. Adopting a critical approach to the implementation of the Convention of Rights of a Child authors nevertheless confirm its relevance for protecting minor migrants’ rights in practice. Authors deconstruct power relations residing within the discourses of children’s rights and best interests, demonstrating that these rights are constructed and decided upon by those in power who make decisions on behalf of those who do not possess authority. Authors further on explore normative and methodological aspects of Article 3 of the Convention on the Rights of a Child and its relevance for asylum and migration legislation. The second part of the book goes on to examine the actual legal framework related to unaccompanied minor migrants and implementation of children’s’ rights and their best interests in the reception, protection, asylum and return procedures. The case studies are based on from the empirical research, on interviews with key experts and unaccompanied minor migrants in Austria, France, Slovenia and United Kingdom. Examining age assessment procedures, unaccompanied minors’ survivals strategies and their everyday life in reception centres the contributors point to the discrepancy between the states’ obligations to take the best interest of the child into account when dealing with unaccompanied minor migrants, and the lack of formal procedures of best interest determination in practice. The chapters expose weaknesses and failures of institutionalized systems in selected European countries in dealing with unaccompanied children and young people on the move.
