Par Carole Pateman, Charles Mills. 2007
Contract and Domination offers a bold challenge to contemporary contract theory, arguing that it should either be fundamentally rethought or…
abandoned altogether. Since the publication of John Rawls's A Theory of Justice, contract theory has once again become central to the Western political tradition. But gender justice is neglected and racial justice almost completely ignored. Carole Pateman and Charles Mills's earlier books, The Sexual Contract (1988) and The Racial Contract (1997), offered devastating critiques of gender and racial domination and the contemporary contract tradition's silence on them. Both books have become classics of revisionist radical democratic political theory. Now Pateman and Mills are collaborating for the first time in an interdisciplinary volume, drawing on their insights from political science and philosophy. They are building on but going beyond their earlier work to bring the sexual and racial contracts together.War on Woke: Why the New McCarthyism Is More Dangerous Than the Old
Par Alan Dershowitz. 2024
In War on Woke: Why the New McCarthyism Is More Dangerous Than the Old, Alan Dershowitz—#1 New York Times bestselling author and one…
of America&’s most respected legal scholars—warns of the danger to the future of civil liberties and equality in America. Alan Dershowitz has been called &“one of the most prominent and consistent defenders of civil liberties in America&” by Politico and &“the nation&’s most peripatetic civil liberties lawyer and one of its most distinguished defenders of individual rights&” by Newsweek. War on Woke exposes new McCarthyite tendencies and tactics of academia, the media, and the business community, especially high tech, that promote closed-minded intolerance. Dershowitz explains that the new woke McCarthyism challenges the basic tenets of the classic liberal (in the traditional sense) state: Freedom of expression; due process; presumption of innocence, right to counsel, equal application of the law; tolerance and respect for differing viewpoints, and that these bedrock principles are rejected by McCarthyite extremists on both the hard left and the hard right. Analyzing the impact of this new woke McCarthyism through the relentless attempts to &“get&” Trump, the attention on the Bidens, and even its international manifestation relative to anti-Semitism, Israel, and the world, Dershowitz investigates the role of media and asks whether the US Supreme Court can constrain this growing threat as new woke McCarthyism becomes mainstream Americanism—especially as the current generation of students and young professionals become our political, media, business, educational, religious, and &“influencer&” leaders.Bartleby and Me: Reflections of an Old Scrivener
Par Gay Talese. 2023
“Literary Legend” (New York) Gay Talese retraces his pioneering career, marked by his fascination with the world's hidden characters. In the…
concluding act of this "incomparable" (Air Mail) capstone book, Talese introduces readers to one final unforgettable story: the strange and riveting all new tale of Dr. Nicholas Bartha, who blew up his Manhattan brownstone—and himself—rather than relinquish his claim to the American dream.“New York is a city of things unnoticed,” a young reporter named Gay Talese wrote sixty years ago. He would spend the rest of his legendary career defying that statement by celebrating the people most reporters overlooked, understanding that it was through these minor characters that the epic story of New York and America unfolded. Inspired by Herman Melville’s great short story “Bartleby, the Scrivener,” Talese now revisits the unforgettable “nobodies” he has profiled in his celebrated career—from the New York Times’s anonymous obituary writer to Frank Sinatra’s entourage. In the book’s final act, a remarkable piece of original reporting titled “Dr. Bartha’s Brownstone,” Talese presents a new “Bartleby,” an unknown doctor who made his mark on the city one summer day in 2006. Rising within the city of New York are about one million buildings. These include skyscrapers, apartment buildings, bodegas, schools, churches, and homeless shelters. Also spread through the city are more than 19,000 vacant lots, one of which suddenly appeared some years ago—at 34 East 62nd Street, between Madison and Park Avenues—when the unhappy owner of a brownstone at that address blew it up (with himself in it) rather than sell his cherished nineteenth-century high-stoop Neo-Grecian residence in order to pay the court-ordered sum of $4 million to the woman who had divorced him three years earlier. This man was a physician of sixty-six named Nicholas Bartha. On the morning of July 10, 2006, Dr. Bartha filled his building with gas that he had diverted from a pipe in the basement, and then he set off an explosion that reduced the fivestory premises into a fiery heap that would injure ten firefighters and five passersby and damage the interiors of thirteen apartments that stood to the west of the crumbled brownstone.Talese has been obsessed with Dr. Bartha’s story and spent the last seventeen years examining this single 20 x 100 foot New York City building lot, its serpentine past, and the unexpected triumphs and disasters encountered by its residents and owners—an unlikely cast featuring society wannabes, striving immigrants, Gilded Age powerbrokers, Russian financiers, and even a turncoat during the War of Independence—just as he has been obsessed with similar “nobodies” throughout his career. Concise, elegant, tragic, and whimsical, Bartleby and Me is the valedictory work of a master journalist.Mother Island: A Daughter Claims Puerto Rico
Par Jamie Figueroa. 2024
A searing memoir that explores the institutions that defined a Puerto Rican woman and what she unlearned to rediscover herself • "A…
lushly written, deeply felt investigation into the meanings of home, lineage and selfhood." —Melissa Febos, bestselling author of Body Work and GirlhoodGrowing up in the Midwest, raised by a Puerto Rican mother who was abandoned by her family, Jamie Figueroa and her sisters were estranged from their culture, consumed by the whiteness that surrounded them. In Mother Island, Figueroa traces her search for identity as shaped by and against a mother who settled into the safety of assimilation. In lyrical, blistering prose, Figueroa recalls a childhood in Ohio in which she was relegated to the background of her mother&’s string of failed marriages; her own marriage in her early twenties to a man twice her age; how her work as a licensed massage therapist helped her heal her body trauma; and how becoming a mother has reshaped her relationship to her family and herself. Only as an adult in New Mexico was Figueroa able to forge her own path, using writing to recast her origin story. In a journey that takes her to Puerto Rico and back, Figueroa looks to her ancestors to reimagine her relationship to the past and to her mother&’s native island, reaching beyond her own mother into a greater experience of mothering and claiming herself. Drawing from Puerto Rican folklore and mythology, a literary lineage of women writers of color, and narratives of identity, Figueroa presents a cultural coming-of-age story. Candid and raw, Mother Island gets to the heart of the question: Who do we become when we are no longer trying to be someone else?Sexual Harassment and the Law in Africa: Country and Regional Perspectives

which is focused on making Europe ‘Fit for the Digital Age’, the European Commission has been busily releasing new texts aimed at regulating a number of technology topics, including data uses, online platforms, cybersecurity, and artificial intelligence. This book identifies three phenomena which are common to all EU digital technologies-relevant regulatory initiatives: act-ification, GDPR mimesis, and regulatory brutality. These three phenomena serve as indicators or early signs of a new European technology law-making paradigm that now seems ready to emerge. They divulge new-found confidence on the part of the EU digital technologies legislator, who has now asserted for itself the right to form policy options and create new rules in the field for all of Europe.Bringing together an analysis of the regulatory initiatives for the management of technology topics in the EU for the first time, this book will be of interest to academics, policymakers, and practitioners, sparking academic and policymaking interest and discussion. The Law of Cryonics: A Legal Philosophical and Financial Analysis
Par Pierre de Gioia Carabellese, Camilla Della Giustina. 2024
This book, through the lens of interdisciplinary legal analysis, draws a subtle balance between bioethics and financial regulation, with the…
latter playing an unexpectedly crucial role in the way life may potentially be governed. The legal topic of human preservation or cryoconservation was initially developed in the United States in the case of Donaldson v. van de Kamp. More recently, the subject arose in Europe as a result of a decision of the High Court, Family Division, London. This new theme of cryoconservation has unfolded through multifaceted forms, including its impact on regulation. In an area that may, at least prima facie, be regarded as belonging to the traditional realm of medical law, the findings presented here suggest that its potential has strong economic implications. The work argues that it is necessary also to look at this subject from a more interdisciplinary perspective, drawing a fil rouge between two otherwise seemingly opposing areas of law: medical law and financial regulation. The legal framework draws on the Anglo-American, and the United Kingdom in particular, along with civil law analysis from Italy. The work will be of interest to researchers and academics in the areas of medical law, legal philosophy, financial law, property law and insurance law.Indian Practice of International Law: Global Norms and their Domestic Enforcement

industries, affecting the legal, business, manufacturing, and healthcare sectors. This contributed volume aims to develop our understanding of the legal and ethical challenges posed by artificial intelligence and robotics technologies and the appropriate intellectual property based legal and regulatory responses. It provides a philosophical and legal framework for considering concepts and principles that relate to the development and use of such technologies at the international, regional, and national levels. The legal discourse in IP concerns the ever-growing AI sector and how businesses can protect their IP and incorporate AI. Moral sentiments often take a back seat to market sentiments, even in shaping the direction of ethical business strategy. This anomaly persists despite growing interest in ethics and IP. Taking an interdisciplinary and diverse perspective, this book enriches the evolving definition and scope of IP literature by focusing on actors, products and regulation that shape the business sector. Considering the gap between theory and practice, this book bridges academic and professional knowledge in unpacking legal, ethical and governance issues in the intellectual property industry. In an effort to include as many viewpoints as possible, contributions have been gathered from diverse fields, including business, ethics, governance, law, philosophy and technology studies. This book will appeal to academics in the field of intellectual property, business ethics, AI, emerging technologies and strategic innovation, as well as practitioners and policy makers.Enticements: Queer Legal Studies (LGBTQ Politics)

exceptional group of interdisciplinary scholars comes together to contribute to the field of Queer Legal Studies. The essays investigate a wildly proliferating assortment of genders, sexualities, and intimacies, questioning how they have been regulated, criminalized, or privileged by law and other regulatory forces.Enticements expands and expounds on the discipline of queer legal studies. system—from foster care to incarceration—that exposes the deep-rooted biases shaping the system, witnessed through the lives of several Black families.Dr. Jessica Pryce knows the child welfare system firsthand and, in this long overdue book, breaks it down from the inside out, sharing her professional journey and offering the crucial perspectives of caseworkers and Black women impacted by the system. It is a groundbreaking and eye-opening confrontation of the inherent and systemic racism deeply entrenched within the child welfare system.Pryce started her social work career with an internship where she was committed to helping keep children safe. In the book, she walks alongside her close friends and even her family as they navigate the system, while sharing her own reckoning with the requirements of her job and her role in the systemic harm. Through poignant narratives and introspection, readers witness the harrowing effects of a well-intentioned workforce that has lost its way, demonstrating how separations are often not in a child’s best interests. With a renewed commitment to strengthening families in her role as activist, Pryce invites the child welfare workforce to embark on a journey of self-reflection and radical growth. At once a framework for transforming child protective services and an intimate, stunning first-hand account of the system as it currently operates, Broken takes everyday scenarios as its focus rather than extreme child welfare cases, challenging readers to critically examine their own mindsets and biases in order to reimagine how we help families in need.Deals: The Economic Structure of Business Transactions

business deals, designed to maximize value for your side.Business transactions take widely varying forms—from multibillion-dollar corporate mergers to patent licenses to the signing of an all-star quarterback. Yet every deal shares the same goal, or at least should: to maximize the joint value created and to distribute that value among the parties. Building on decades of experience teaching and advising on business deals, Michael Klausner and Guhan Subramanian show how to accomplish this goal through rigorous attention to designing incentives, conveying information, and specifying parties’ rights and obligations.Deals captures the range of real-life transactional complexities with case studies covering Microsoft’s acquisition of LinkedIn, Scarlett Johansson’s contract dispute with Disney over the release of Black Widow, litigation surrounding LVMH’s pandemic-disrupted acquisition of Tiffany, the feud between George Norcross and Lewis Katz over ownership of the Philadelphia Inquirer, NBC/Viacom’s negotiation with Paramount over the final three seasons of Frasier, and many more. In clear, concise terms, Klausner and Subramanian establish the basic framework of negotiation and the economic concepts that must be addressed in order to maximize value. They show how to tackle challenges, such as information asymmetry between buyer and seller, moral hazard, and opportunistic behavior. And the authors lay out responses to common risks associated with long-term contracts, emphasizing that a deal’s exit rights should be carefully considered at the start of transaction design.Unique in its practical application of economic theory to actual dealmaking, this book will be an indispensable resource for students and for professionals across the business and legal world.Soldiers and Kings: Survival and Hope in the World of Human Smuggling

As those borders harden, the demand for smugglers who aid migrants across them increases every year. Yet the real lives and work of smugglers—or coyotes, or guides, as they are often known by the migrants who hire their services—are only ever reported on from a distance, using tired tropes and stereotypes, often depicted as boogie men and violent warlords. In an effort to better understand this essential yet extralegal billion dollar global industry, internationally recognized anthropologist and expert Jason De León embedded with a group of smugglers moving migrants across Mexico over the course of seven years. The result of this unique and extraordinary access is SOLDIERS AND KINGS: the first ever in-depth, character-driven look at human smuggling. It is a heart-wrenching and intimate narrative that revolves around the life and death of one coyote who falls in love and tries to leave smuggling behind. In a powerful, original voice, De León expertly chronicles the lives of low-level foot soldiers breaking into the smuggling game, and morally conflicted gang leaders who oversee rag-tag crews of guides and informants along the migrant trail. SOLDIERS AND KINGS is not only a ground-breaking up-close glimpse of a difficult-to-access world, it is a masterpiece of narrative nonfiction.Fighting Mad: Resisting the End of Roe v.
