The Tokyo Trial and War Crimes in Asia
Par Mei Ju-Ao. 2020
The book examines the process and the impact of the International Military Tribunal for the Far East (IMTFE), otherwise known…
as the Tokyo Trial, which was convened in 1946 to try the Japanese leaders accused of committing war crimes during World War II. Offering valuable research materials, it studies the lessons learned from the failed attempt after World War I, and the background and establishment of the IMTFE. It elaborates on the Charter, the Indictment, the Proceeding Records, and the Judgment of the IMTFE, with an emphasis on principles of international law and other legal questions, often with reference to the Nuremberg Trial. It also discusses the structure and different parts of the court organization, the selection and prosecution of Class-A war criminals, and the trial procedures especially those relating to evidence. The author’s personal experience and his criticism of certain aspects of the Tokyo Trial make it most insightful for the reader. From the perspective of a Chinese judge, this unique text brings in the dimensions of both international law and international relations, and allows us to measure the significance and legacy of the Tokyo Trial for contemporary international criminal justice. The author’s manuscript of this book was written in Chinese in the mid-1960s as part of a larger project, and was initially published in 1988. This is the first time that this book has been translated into English. The book represents original research in a field of study rarely pursued while analysing the intellectual dimensions of disputes over…
ethically sensitive issues that occur in European Union politics. These disputes are generally analysed at ideological, ethical, economic and interstate levels. However, these references do not suffice in understanding the issue, which is related to a divergent perception of the essence of humanity and thus the subject matter of anthropology. The main research objective of the monograph is therefore to reconstruct the sources and the specific European Union way of thinking about the human being. Methodologically, the book expands the understanding of political anthropology within political science and presents a range of suitable instruments for pursuing anthropological research. At the theoretical level, it proposes an anthropological typology of the main currents of European political thought and reveals their prominence for the anthropological orientation of the EU's axiology. Empirically, it provides an analysis of the anthropological features of European Union institutions and policies in addition to discussing the relation between the axiological and anthropological positions of the main political and national groups within the EU.Franz Brentano’s Philosophy After One Hundred Years: From History of Philosophy to Reism (Primary Sources in Phenomenology)
Par Denis Fisette, Guillaume Fréchette, Hynek Janoušek. 2020
This volume brings together contributions that explore the philosophy of Franz Brentano. It looks at his work both critically and…
in the context of contemporary philosophy. For instance, Brentano influenced the phenomenology of Edmund Husserl, the theory of objects of Alexius Meinong, the early development of the Gestalt theory, the philosophy of language of Anton Marty, the works of Carl Stumpf in the psychology of tone, and many others. Readers will also learn the contributions of Brentano's work to much debated contemporary issues in philosophy of mind, ontology, and the theory of emotions. The first section deals with Brentano’s conception of the history of philosophy. The next approaches his conception of empirical psychology from an empirical standpoint and in relation with competing views on psychology from the period. The third section discusses Brentano’s later programme of a descriptive psychology or “descriptive phenomenology” and some of his most innovative developments, for instance in the theory of emotions. The final section examines metaphysical issues and applications of his mereology. His reism takes here an important place. The intended readership of this book comprises phenomenologists, analytic philosophers, philosophers of mind and value, as well as metaphysicians. It will appeal to both graduate and undergraduate students, professors, and researchers in philosophy and psychology.Political Deference in a Democratic Age: British Politics and the Constitution from the Eighteenth Century to Brexit
Par Catherine Marshall. 2021
This book explores the concept of deference as used by historians and political scientists. Often confused and judged to be…
outdated, it shows how deference remains central to understanding British politics to the present day. This study aims to make sense of how political deference has functioned in different periods and how it has played a crucial role in legitimising British politics. It shows how deference sustained what are essentially English institutions, those which dominated the Union well into the second half of the twentieth century until the post-1997 constitutional transformations under New Labour. While many dismiss political and institutional deference as having died out, this book argues that a number of recent political decisions – including the vote in favour of Brexit in June 2016 – are the result of a deferential way of thinking that has persisted through the democratic changes of the twentieth century. Combining close readings of theoretical texts with analyses of specific legal changes and historical events, the book charts the development of deference from the eighteenth century through to the present day. Rather than offering a comprehensive history of deference, it picks out key moments that show the changing nature of deference, both as a concept and as a political force. An Introduction to the Criminology of Genocide
Par William R. Pruitt. 2021
This textbook provides an accessible and interdisciplinary introduction to genocide with an emphasis on the criminal aspect of genocide. It…
draws on sociological, political, and historical concepts to discuss how they contribute to our understanding of genocide as an international crime. It walks students through the evolution of genocide as a criminal act and the legal responses available using case studies to demonstrate how concepts work in action. It combines Criminology and Law, arguing that Criminology can help explain the ‘why and how’ while Law can explain the responses to crime. This textbook includes a chapter on genocide denial as well as discussion questions at the end of the chapters, boxed examples, and further reading. It speaks to students in Criminology, Law, Socio-Legal Studies, and beyond, as well as to practitioners in the criminal justice field.Clinical Pathways in Stroke Rehabilitation: Evidence-based Clinical Practice Recommendations
Par Thomas Platz. 2021
This open access book focuses on practical clinical problems that are frequently encountered in stroke rehabilitation. Consequences of diseases, e.g.…
impairments and activity limitations, are addressed in rehabilitation with the overall goal to reduce disability and promote participation. Based on the available best external evidence, clinical pathways are described for stroke rehabilitation bridging the gap between clinical evidence and clinical decision-making. The clinical pathways answer the questions which rehabilitation treatment options are beneficial to overcome specific impairment constellations and activity limitations and are well acceptable to stroke survivors, as well as when and in which settings to provide rehabilitation over the course of recovery post stroke. Each chapter starts with a description of the clinical problem encountered. This is followed by a systematic, but concise review of the evidence (RCTs, systematic reviews and meta-analyses) that is relevant for clinical decision-making, and comments on assessment, therapy (training, technology, medication), and the use of technical aids as appropriate. Based on these summaries, clinical algorithms / pathways are provided and the main clinical-decision situations are portrayed. The book is invaluable for all neurorehabilitation team members, clinicians, nurses, and therapists in neurology, physical medicine and rehabilitation, and related fields. It is a World Federation for NeuroRehabilitation (WFNR) educational initiative, bridging the gap between the rapidly expanding clinical research in stroke rehabilitation and clinical practice across societies and continents. It can be used for both clinical decision-making for individuals and as well as clinical background knowledge for stroke rehabilitation service development initiatives.Empiricism and Philosophy of Physics (Synthese Library #434)
Par Lars-Göran Johansson. 2021
This book presents a thoroughly empiricist account of physics. By providing an overview of the development of empiricism from Ockham…
to van Fraassen the book lays the foundation for its own version of empiricism. Empiricism for the author consists of three ideas: nominalism, i.e. dismissing second order quantification as unnecessary, epistemological naturalism, and viewing classification of things in natural kinds as a human habit not in need for any justification. The book offers views on the realism-antirealism debate as well as on the individuation of theories as a thoroughly neglected aspect of underdetermination. The book next discusses a broad range of topics, including the predicates body, spatial distance and time interval, the ontology of electromagnetism, propensities, the measurement problem and other philosophical issues in quantum theory. Discussions about the direction of time and about string theory make up the final part of the book.I and Thou

organizations in various countries around the world; in other words, it characterizes the worldwide evolution of the History of Management Thought (HMT) - ideas, concepts, theories, paradigms, and scientific schools - from Antiquity to the present. The book is the outcome of extensive research, based on the analysis, generalization, and systematization of foreign and domestic published literature, as well as on the gathering and analysis of unique archival materials. For the first time in the historical and managerial literature, the book puts forward original definitions of three historical and managerial sciences - the History of Management, the History of Management Thought, and the Historiography of Historical and Managerial Research. It addresses the main challenges in pursuing Historical and Scientific Research (HSR), the main “subject” levels of HSR and specific methodological problems concerning HMT, as well as epistemological methods for identifying key factors in and causes of the advent and evolution of HMT. This book presents both the origins of management thought dating back to the 5th millennium BC and the latest management concepts of the early 21st century. In particular, it traces the origins and sources of management thought, reflected in the works of thinkers and statesmen of the Ancient World (Egypt, Western Asia, China, India, Greece, and Rome), the era of feudalism, and the Middle Ages (Byzantium, Western Europe, and England), the era of inception capitalism (Western Europe and the USA), as well as the new and recent history of management thought of the 20th and 21st centuries. In addition, for the first time in History of Management literature, it presents the history of Russian management thought from the 9th century to modern concepts and scientific schools.Simone Weil, Beyond Ideology?
Par Sophie Bourgault, Julie Daigle. 2020
In the last decade, interest in the writings of French philosopher Simone Weil (1909-1943) has surged. Weil is admired for her militant…
syndicalism, her factory experience and participation in the French resistance, but it is above all the eclectic and rich character of her work that has increasingly attracted scholarly attention. Weil reflected on subjects as diverse as quantum physics, Greek tragedy, bankruptcy, colonialism, technology, education, and religious metaphysics, but perhaps most interesting is the way that her work seems to defy any clear ideological labelling: Marxist, anarchist, liberal, conservative and republican all seem to fall short in describing the complexity of Weil’s thinking. Adding to the interpretive difficulty is the fact that Weil often expressed biting criticisms of most things political. What this edited volume argues is that it is precisely Weil’s unclassifiable nature, combined with her sharp and sometimes ambivalent criticisms of politics, that make her work a most timely and fascinating object of study for contemporary political philosophy. It proposes a two-pronged approach to her thought: first, via a series of conversations set up between Weil and key authors in modern and contemporary political theory (e.g. Sandel, Rawls, Ahmed, Agamben, Orwell); and secondly, via a close study of Weil’s reflections on various ideologies. The goal of this book is not to position Simone Weil squarely within a single ideological tradition but rather to propose that her thought might allow us to critically engage with various ideologies in the history of political ideas. This textbook offers a detailed introduction to the methodology and applications of sequent calculi in propositional logic. Unlike other texts…
concerned with proof theory, emphasis is placed on illustrating how to use sequent calculi to prove a wide range of metatheoretical results. The presentation is elementary and self-contained, with all technical details both formally stated and also informally explained. Numerous proofs are worked through to demonstrate methods of proving important results, such as the cut-elimination theorem, completeness, decidability, and interpolation. Other proofs are presented with portions left as exercises for readers, allowing them to practice techniques of sequent calculus. After a brief introduction to classical propositional logic, the text explores three variants of sequent calculus and their features and applications. The remaining chapters then show how sequent calculi can be extended, modified, and applied to non-classical logics, including modal, intuitionistic, substructural, and many-valued logics.Sequents and Trees is suitable for graduate and advanced undergraduate students in logic taking courses on proof theory and its application to non-classical logics. It will also be of interest to researchers in computer science and philosophers.Re-thinking Religious Pluralism: Moving Beyond Liberal Tolerance
Par Bindu Puri, Abhishek Kumar. 2021
This book combines the mainstream liberal arguments for religious tolerance with arguments from religious traditions in India to offer insights…
into appropriate attitudes toward religious ‘others’ from the perspective of the devout. The respective chapters address the relationship between religions from a comparative perspective, helping readers understand the meaning of religion and the opportunities for interreligious dialogue in the works of contemporary Indian philosophers such as Gandhi and Ramakrishna Paramhansa. It also examines various religious traditions from a philosophical viewpoint in order to reassess religious discussions on how to respond to differing and different religious others. Given its comprehensive coverage, the book is of interest to scholars working in the areas of anthropology, philosophy, cultural and religious diversity, and history of religion.

Written by leading experts from all continents, its 26 chapters present a comparative analysis of cutting-edge legal issues of the 21st century. While each of the countries covered stands alone as a sovereign state, in a technologically advanced world their disparate systems nonetheless show comparable strategies in dealing with complex legal issues. Several of the chapters show how, in addition to state normative production and state adjudication, a growing panoply of non-state instruments and non-state adjudication are becoming more and more central to the legal field. This book is a key addition to the library of any scholar wanting to keep abreast of the major trends in contemporary law. Representing the current state of law in a vast range of areas, it covers each topic from a comparative perspective. This book explores the question of what it means to be a human being through sustained and original analyses of…
three important philosophical topics: relativism, skepticism, and naturalism in the social sciences. Kevin Cahill’s approach involves an original employment of historical and ethnographic material that is both conceptual and empirical in order to address relevant philosophical issues. Specifically, while Cahill avoids interpretative debates, he develops an approach to philosophical critique based on Cora Diamond’s and James Conant’s work on the early Wittgenstein. This makes possible the use of a concept of culture that avoids the dogmatism that not only typifies traditional metaphysics but also frequently mars arguments from ordinary language or phenomenology. This is especially crucial for the third part of the book, which involves a cultural-historical critique of the ontology of the self in Stanley Cavell’s work on skepticism. In pursuing this strategy, the book also mounts a novel and timely defense of the interpretivist tradition in the philosophy of the social sciences. Towards a Philosophical Anthropology of Culture will be of interest to researchers working on the philosophy of the social sciences, Wittgenstein, and philosophical anthropology.Therapeutic Voicework: Principles and Practice for the Use of Singing as a Therapy

for copyright infringement form an integral part of its functioning, and serve to balance copyright's grant of a private benefit to authors/creators with the broader public interest. With contributors from all over the world, this handbook offers a systematic, thorough study of copyright limitations and exceptions adopted in major jurisdictions, including the United States, the European Union, and China. In addition to providing justifications for these limitations, the chapters compare differences and similarities that exist in major jurisdictions and offer suggestions about how to improve the enforcement of copyright limitations domestically and globally. This work should appeal to scholars, policymakers, attorneys, teachers, judges, and students with an interest in the theories, policies, and doctrines of copyright law.A groundbreaking new behavioral model that explains what drives us, and why. From tireless marketers to pandering politicians, the forces of…
modernity have lulled us into lazy categorizations of people, erasing the natural nuances of being human. We are all now accustomed to being reduced to a demographic—man, woman, black, white, old, young. But while these factors may inform our lived experience, what if there is something more fundamentally important that determines our behavior? Bob Raleigh, founder of PathSight Predictive Science, argues that biological instincts are the most foundational determinants of our behavior. PathSight has pioneered a new model that draws on the latest findings in neuroscience, data science, and behavioral science to classify people in five distinct groups, depending on what they instinctively care about most: nurturing, fairness, loyalty, authority, or purity. Their data, drawn from large-scale studies with over 50,000 participants, show that people who share the same instinctual patterns will engage the world in extremely predictable ways, regardless of age, gender, ethnicity, lifestyle, income, and education. Knowing the impact that instinct has on behavior has all kinds of advantages. You can tailor any communication to make it maximally effective for a particular audience. You can strive to empathize with a person you&’ve always found mystifying. And of course, understanding what truly makes you tick is an invaluable step on your journey to self-discovery.
