Aspiration and Reality in Legal Education (G - Reference, information And Interdisciplinary Subjects Ser.)
Par David Sandomierski. 2020
Contrary to conventional narratives about legal education, Aspiration and Reality in Legal Education reveals a widespread desire among law teachers…
to integrate both theory and practice into the education of versatile and civic-minded lawyers. Despite this stated desire, however, this aspiration is largely unrealized due to a host of intellectual and institutional factors that produce a profound gap between what professors believe about law and the ideas they communicate through their teaching. Drawing on interviews with over sixty law professors in Canada, David Sandomierski makes two important empirical discoveries in this book. First, he establishes that, contrary to a dominant narrative in legal education that conceives of theory and practice as oppositional, the vast majority of law professors consider theory to be vitally important in preparing "better lawyers." Second, he uncovers a significant gap between the realist theoretical commitments held by a majority of professors and the formalist theories they almost uniformly convey through their teaching and conceptions of legal reasoning. Understanding the intellectual and institutional factors that account for these tensions, Sandomierski argues, is essential for any meaningful project of legal education reform.Beauty or Statistics: Practice and Science in Dutch Livestock Breeding, 1900–2000
Par Bert Theunissen. 2020
In the 1970s, scientists claimed that farm animal breeding was finally evolving from an art into a science. In their…
view, the switch to scientific breeding was as inevitable as the ongoing process of agricultural modernization. However, the art-to-science scenario is too simplistic to do justice to the complex dynamic that characterized the transformation of the field. The livestock breeds that take centre stage in this book – dairy cattle, chickens, pigs, sheep, and horses – were products of the twentieth century. The methods used by breeders to improve their animals, however, were much older. Tracing the history of practical stockbreeding, the role of Mendelism in scientific breeding, and the emergence of quantitative genetics, Beauty or Statistics shows that the story of the scientific modernization of livestock breeding can be more fruitfully analyzed from the perspective of changing cultures of breeding, taking practical, commercial, normative, and aesthetic considerations into account. The nature of employment is changing: low wage jobs are increasingly common, fewer workers belong to unions, and workplaces are…
being transformed through the growth of contracting-out, franchising, and extended supply chains. Closing the Enforcement Gap offers a comprehensive analysis of the enforcement of employment standards in Ontario. Adopting mixed methods, this work includes qualitative research involving in-depth interviews with workers, community advocates, and enforcement officials; extensive archival research excavating decades of ministerial records; and analysis of a previously untapped source of administrative data collected by Ontario’s Ministry of Labour. The authors reveal and trace the roots of a deepening "enforcement gap" that pervades nearly all aspects of the regime, demonstrating that the province’s Employment Standards Act (ESA) fails too many workers who rely on the floor of minimum conditions it was devised to provide. Arguably, there is nothing inevitable about the enforcement gap in Ontario or for that matter elsewhere. Through contributions from leading employment standards enforcement scholars in the US, the UK, and Australia, as well as Quebec, Closing the Enforcement Gap surveys innovative enforcement models that are emerging in a variety of jurisdictions and sets out a bold vision for strengthening employment standards enforcement. Par Annick Masselot, Eugenia Caracciolo di Torella. 2020
This book explores the emerging engagement of EU law with care and carers. The book argues that the regulation of…
care by the EU is crucial because it enables the development of a broad range of policies. It contributes to the sustainability of society and ultimately it enables individuals to flourish. Yet, to date, the EU approach to regulating the caring relationship remains piecemeal and lacks the underpinning of a cohesive strategy. Against this backdrop, this book argues that the EU can and must take leadership in this area by setting principles and standards in accordance with the values of the treaty, in particular gender equality, human dignity, solidarity and well-being. The book further makes a case for a stronger protection for carers, who should not only be protected against discrimination, but should also be supported, valued and put in a position to make choices and lead full lives. In order to achieve this, a proactive approach to rebalancing the relationship between paid and unpaid work is necessary. Ultimately, the book puts forward a series of legal and policy recommendations for a holistic approach to care in the EU.Contaminants and Clean Technologies

Par Marianne Nielsen, Linda M. Robyn. 2019
There is powerful evidence that the colonization of Indigenous people was and is a crime, and that that crime is…
on-going. Achieving historical colonial goals often meant committing acts that were criminal even at the time. The consequences of this oppression and criminal victimization is perhaps the critical factor explaining why Indigenous people today are overrepresented as victims and offenders in the settler colonist criminal justice systems. This book presents an analysis of the relationship between these colonial crimes and their continuing criminal and social consequences that exist today. The authors focus primarily on countries colonized by Britain, especially the United States. Social harm theory, human rights covenants, and law are used to explain the criminal aspects of the historical laws and their continued effects. The final chapter looks at the responsibilities of settler-colonists in ameliorating these harms and the actions currently being taken by Indigenous people themselves.A History of Humanitarian Intervention
Par Mark Swatek-Evenstein. 2020
The question of 'humanitarian intervention' has been a staple of international law for around 200 years, with a renewed interest…
in the history of the subject emerging in the last twenty years. This book provides a chronological account of the evolution of the discussion and uncovers the fictional narrative provided by international lawyers to support their conclusions on the subject, from justifications and arguments for 'humanitarian intervention', the misrepresentation of great power involvement in the Greek War of Independence in 1827, to the 'humanitarian intervention that never was', India's war with Pakistan in 1971. Relying on a variety of sources, some of them made available in English for the first time, the book provides an undogmatic, alternative history of the fight for the protection of human rights in international law.Unprecedented: A Simple Guide to the Crimes of the Trump Campaign and Presidency

Par Catherine O'Rourke. 1998
What role do transitional justice processes play in determining the gender outcomes of transitions from conflict and authoritarianism? What is…
the impact of transitional justice processes on the human rights of women in states emerging from political violence? Gender Politics in Transitional Justice argues that human rights outcomes for women are determined in the space between international law and local gender politics. The book draws on feminist political science to reveal the key gender dynamics that shape the strategies of local women’s movements in their engagement with transitional justice, and the ultimate success of those strategies, termed ‘the local fit’. Also drawing on feminist doctrinal scholarship in international law, ‘the international frame’ examines the role of international law in defining harms against women in transitional justice and in determining the ‘from’ and ‘to’ of transitions from conflict and authoritarianism. This book locates evolving state practice in gender and transitional justice over the past two decades within the context of the enhanced protection of women’s human rights under international law. Relying on original empirical and legal research in Chile, Northern Ireland and Colombia, the book speaks more broadly to the study of gender politics and international law in transitional justice.Pollos de campo

socio-legal studies. It focuses particularly on the relationship between law and society described in recent social systems theory as ’structural coupling’. The first part of the book presents a reconstruction of theoretical tendencies in the field of socio-legal studies, characterised by the emergence of a transnational model of legal systems no longer connected to territorial borders and culturally specific aspects of single legal orders. In the following parts of the book, the contributions analyse some concrete cases of interrelation between law and society from an empirical and theoretical perspective.Non-state actors have always been treated with ambivalence in the works of international law. While their empirical existence is widely…
acknowledged and their impact and influence uncontested, non-state actors are still not in the centre of international legal research. The idea that non-state actors are not law-makers, however, stands in sharp contrast with the growing notion of non-state actors as law-takers. This book examines the position of non-state actors in international law as law-makers and law-takers and questions whether these different positions can or should be separated from each other. Each contribution reveals both the political and normative aspects of the question as well as the positivistic possibilities and constraints to accommodate non-state actors as law-takers and law-makers in the contemporary international legal system. Altogether, each expert reveals that the position of non-state actors in international law is not a fixed one but changes with the functional and theoretical perspectives of the observer. Non-State Actor Dynamics in International Law is a welcomed addition to an under researched field of legal study. An indispensable read to scholars and policy makers wishing to gain new insights into general discourse on non-state actors in international law and the process of norm formation in the international realm.European Yearbook of Constitutional Law 2019: Judicial Power: Safeguards and Limits in a Democratic Society (European Yearbook of Constitutional Law #1)
Par Gerhard van der Schyff, Ernst Hirsch Ballin, Maarten Stremler. 2020
The European Yearbook of Constitutional Law (EYCL) is an annual publication initiated by the Department of Public Law and Governance…
at Tilburg University and devoted to the study of constitutional law. It aims to provide a forum for in-depth analysis and discussion of new developments in the field, both in Europe and beyond. This inaugurate volume examines the safeguards and limits of judicial power in a variety of constitutional systems, both at the national and supranational level. The book approaches the judiciary as part of the constitutional system operating within a legal order that connects the citizens and institutions of the state to each other. Looking at the judiciary from this broader perspective, the traditional doctrine of the separation of powers would appear no longer to adequately represent the diversity and complexity of constitutional systems and their democratic legitimacy. Judicial independence does not mean isolation, but should better be understood as institutionalizing relationships that legitimize the power of the courts. The notions of ‘safeguards’ and ‘limits’ indicate the reciprocally enabling and protecting nature of these relationships. In recognition of this, the contributions to this volume analyse these safeguards and limits as relations existing within a complex constitutional architecture.State institutions, today, are involved in a fundamental transformation of their selfunderstanding as a result of changes in political culture. Several contributions to this volume provide examples of political criticism and pressure on the judiciary, against which the usual guarantees are unable to provide adequate protection. A convincing and effective response to threats to the judiciary’s independence requires a detailed and precise analysis of the judiciary’s constitutional safeguards and limits. This book offers a step in that direction.Handbook on Good Treaty Practice
Par Robert Beckman, Jill Barrett. 2020
This Handbook aims to provide practical guidance on good treaty practice. It presents a range of examples from the practice…
of several States and international organisations and explains the actions that need to be taken to create a new treaty, bring it into force, operate it, amend it and wind it up, on both the international and the domestic plane. It also explores what constitutes good treaty practice, and develops generic principles or criteria against which to evaluate these examples. It provides a useful analytical tool to enable each government and international organisation to identify and develop the best treaty practice for their circumstances, recognising that one size does not necessarily fit all. It will be of interest to those working with treaties and treaty procedures in governments, international organisations and legal practice, as well as legal academics and students wishing to gain insight into the realities of treaty practice.Policing the Womb: Invisible Women and the Criminalization of Motherhood
Par Michele Goodwin. 2020
Policing the Womb brings to life the chilling ways in which women have become the targets of secretive state surveillance…
of their pregnancies. Michele Goodwin expands the reproductive health and rights debate beyond abortion to include how legislators increasingly turn to criminalizing women for miscarriages, stillbirths, and threatening the health of their pregnancies. The horrific results include women giving birth while shackled in leg irons, in solitary confinement, and even delivering in prison toilets. In some states, pregnancy has become a bargaining chip with prosecutors offering reduced sentences in exchange for women agreeing to be sterilized. The author shows how prosecutors may abuse laws and infringe women's rights in the process, sometimes with the complicity of medical providers who disclose private patient information to law enforcement. Often the women most affected are poor and of color. This timely book brings to light how the unrestrained efforts to punish and police women's bodies have led to the United States being the deadliest country in the developed world to be pregnant.I Am a Beaver

Par David P. Farrington, Andreas Kapardis, Bryanna Fox, Olivia C. Hambly. 2020
Offender profiling is an investigative tool used to narrow down the range of potential suspects for a crime by predicting…
the personality, behavioral, and demographic characteristics that an offender is likely to possess, based upon information collected at the crime scene. While offender profiling has been popularized by TV shows and movies such as Criminal Minds, Silence of the Lambs, and Mindhunter, the real-world impact of offender profiling is largely unknown. This book discusses the history of offender profiling, summarizes research on offender profiling methods, and reviews offender profiling evaluations of accuracy and applied impact. This book also describes a promising new offender profiling methodology called evidence-based offender profiling. This new method relies upon empirical data and scientific methods to develop, evaluate, and replicate offender profiles, thereby increasing offender profiling’s accuracy and utility for active police investigations. It uses prior information about statistical regularities between types of offenders and types of offenses to predict the characteristics of offenders in unsolved cases. A discussion of the future of offender profiling research and implications for law enforcement is also included. This book also explains how practitioners can benefit from the use of empirically tested and validated profiles in their unsolved investigations and how the use, continued research, and evaluation of evidence-based offender profiling can advance the quality, prestige, and utility of the field of offender profiling.
